please help.
We recently recieved a home visit from a large labrador rescue centre. I explained to them that we wanted a dog who was good with children and dogs as we have a 6 year old lab and a 5 year old daughter. they noted that the temperment was our only requirement, we didnt mind a !!!!! or dog, etc. 2 days later, surprise they found us the "perfect" dog, rescued from Ireland and would fit in with our family fantasticly. We collected the dog (lab cross) paying a "donation" for £175 (donation however that was the price we were told to pay) & 4 days later he savagely attacked our lab (totally unprovoked!), I had to pull him off my dog who recieved 4 large wounds. Really upset and shocked I contacted the centre, lady very rudely told me to wait 2 months and to give the dog another chance. i contacted my vet who advised me to remove the dog as he clearly had severe behavior problems, possibly possesion issues and would possibly attack our daughter too. We returned the dog to the centre, all very upset and shocked, took my dog to the vets for antibiotics etc for his wounds. The centre refused to refund all or part of the £175 stating that it was non refundable. I explained that we had needed a dog and child friendly dog and it was clearly not good with dogs, hence the mis sale. They were rude and arrogant, I contacted the chair man who agreed to refund the money as it was a sad outcome. 4 weeks later, no cheque contacted by the lady who is a trustee who placed the dog with us in the begining, she was so rude and agressive, called me a bad dog owner, that she would never refund me the money, it is a charity....... blah blah blah..... she over ruled the chairpersons decision. I wrote to the charity, contacted my vet who also wrote explaining that it was correct to return the dog due to the scale of dog attack etc, and I have had no response, not even a reply.
I dont know what to do as I am furious with the attitude of the charity. i realised that i had to pay £175 for the dog but I didnt realise that the charity did not find a suitable dog. It would have been dangerous to have kept the dog. we now are £175 worse off, and with no dog. i am seriously considering going to court as i feel so strongly. They have accepted no liability with placing this dog with our family. They have not offered us any refund at all. Just because it was a non refundable donation I dont feel that it gives the charity the right to sell dogs and place them hap hazardly in homes, risking safety etc. please let me know what you think. I know a dog falls under the Sale of Goods act 1979 so therefore must be fit for purpose, but paying the "donation" does that rid all liability from the charity.
also the charity resold the dog to another home 1 week later for £175 to a home with no dogs therefore the charity have sold the same dog for £350! i thought it was a charity who's aim is to rehome unwanted labradors not to make a business.... .
any idea if i have a case to go to court as I feel like they are bullying me
because they are a charity etc,

Very sad situation.
Can I ask if the dogs met before your new Lab came home for the first time? Did they get on ok then?0 -
I too would be completely livid, and agree with you wholeheartedly, I would get some advice from your CAB and maybe contact your local paper.
Their attitude stinks and thank goodness the dog didn't attack your daughter.
They need to check the temperments of their dogs more carefully before rehoming.0 -
Hi , yes I took my dog with me when i went to collect the rescue dog and there was no aggresion then. I then took them both home and the rescue dog was very confident and pushy really but no aggression showing. It was only on the 4th day that i was in the lounge with both dogs, sitting on the floor, I moved the rescue dog growled so I stood up and my dog got up to follow me out of the room and that is when the rescue dog lunged at my dogs throat and would not cease biting and attacking. I t was horrendous, totally unprovoked and out of the blue. I was advised the next day by the centre ot give the dog 2 months to give it a fair trial, yet my concern was that they said it was good with dogs, and clearly wasnt I was too upset as my dog was petrified of the rescue dog, and I waasnt willing to risk another attack on my dog or my daughter.Kim-DogsBlog wrote: »Very sad situation.

Well there are no guarentees with animals, no dog can be said to be good with other dogs. It is a massive risk to introduce one to another and to try to get them to live together as adults when they don't already know each other. The risk is even greater when one of those animals is a rescue dog with an uncertain and possibly difficult past.
The centre will have done their best to find you a suitable dog, if that didn't work out they will be as gutted as you because they want their dogs to have a settled home life.
You do not have the protection of the sale of goods act as you did not buy this dog. You were given a dog and you made a donation to the rescue centre to offset some of their expenses. In all probability all your donation paid for was the vet costs of having the animal vaccinated and neutered.
This is a charity, they took the dog back at no expense and rehomed it. How tight are you to seek to get your donation back! Would you ask for a refund on your red nose at comic relief if it broke???????
If you'd bought a puppy from a breeder you would have paid a lot more and had no come back if you didn't like the dog after a couple of weeks.0 -
Jimmysgin, you posted this in the consumer forum at 2.30 today and have had loads of responses - can I ask why you're re-posting at 4pm in another thread ????0

The one thing that stops me getting a rescue dog (As much as we would like to) is that the majority that we have seen with other people are ruined as pups and then abandoned.
There is a lot in the saying. "You can not teach old dogs new tricks"
As we have children in the house on a regular basis, it will have to be a pup that we can train.I used to be indecisive but now I am not sure.0 -

Can I ask why you feel the need to post THAT post?
This is the pet forum - maybe the OP wanted advice from people with pets?0 -
... and I'd still like to know why the OP felt the need to post this here when she'd already posted it at 2.30 in the consumer section - and had 8 responses ...?
... and lots more since.0 -
Maybe you should go and look at the other thread and see what responses she got first ...???0
