Excellent stuff Martin, give it to them straight between the eyes, and shout out the message in your own inimitable style - PEOPLE, DON'T PAY PRIVATE PARKING TICKETS, THEY ARE NOT FINES AND NOT LEGALLY ENFORCEABLE!!!!

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.
  • I welcome this very much as long as people dont get advice to pay PPC tickets and then appeal them afterwards..... It should be made perfectly clear that they are invoices and not "fines" . People should be aware of this scam and where they stnd. Maybe also suggest people to visit pepipoo.com for further advice.

ill be listening to the show with interest.
  • The parking company owner normally known as "Perky" came on and tried to pronounce their tickets as legal, got trounced by Martin. good job.

I must have been listening to the different radio station, I am sure I heard Martin agree with Perky and say that 'I think I agree with you' when he stated the best course of action if you get a ticket you dispute is to write immediately and state your reasons for disputing.

Far from Perky getting trounced by Martin, I would suggest you relisten on BBC iPlayer.

Why when Perky is mentioned does an idiot (now called Gay perky) start posting with his utter rubbish ? - I thought the schools were back ?

I Hope the points came across clearly

    1. There's no such things as fines - they're invoices
    2. There are a numebr of strategies - as you know the militant one isn't what I subscribe to - but I hope i put that perspective across as its an important one
    3. I certainly made it clear on my thoughts on private parking tickets and the reputational impact.
    4. I must admit I've not read perky's comments on the boards - but to be fair he came across as articulate on the subject. Though fo course he's a vested interest on behalf of parking companies and span that way (it could equally be argued I did the same on behalf of consumers)

Martin, you made the points clearly and drove a stake through the heart of the private parking industry, despite Perky's lame attempt to defend them. Excellent job, well done!!!

I will listen later with considerable interest.

Was there mention of the wholesale breaches, by these companies, of multiple pieces of legislation. We observe that time and again. Coverage on national radio may perk up Trading Standards.
  • Unfortunately I don't think he had time, the bit with perky was amusing though.

This perky character crops up a lot. I must listen to him.

My comment about perking up Trading Standards was made in total disregard of his existence.

Excellent well balanced effort by MSE Martin.

He explained the '3 routes' that he feels exist.

    1. The 'avoid all aggro' - ie pay up with no query at all [some people will do this either out of ignorance or for a 'quiet life']
    2. The 'militant stance' - ie don't engage at all with the PPC and simply ignore their invoices/demands/emopty threats
and in a kinda new labour way....
    3. The 'MOR [middle of the road]' - ie wait for invoice in the post and then refuse to pay if you feel it's unreasonable

MSE-M advocated the MOR approach, and stopped short of telling everyone to ignore all private 'tickets/invoices'; but he did explain pretty clearly that they were invoices, not PCNs and were not founded in criminal law and were virtually unenforceable. He also put the boot in wrt the 'looks like a proper PCN' mis-leading cr4p from a lot of the wide-boys.

The clamper boyo put up a valiant fight but IMO MSE-M won on points [non-endorsable of course].
