council tax discount

I was getting 25% council tax discount last year as only adult living in house. My son is now back from university and so, as of May, I've been put back to full bill. Since he is unemployed (he's just started the Job Seekers process but has not received any money yet) am I entitled to a discount? If so, do I have to ask for it or will it come through automatically once his Job Seekers goes through?

    Contact the council tax office via by phone or web, for peace of mind if nothing else.

    You can claim Second Adult Rebate, however you will have to phone your local Benefits Office and request a form.
    They will ask you to provide proof of his income, so if you ask your son to write a letter explaining what he has been living off, and provide bank statements to show he's had no income, then they should be able to assess your claim using this info. And then when he is awarded JSA, they can amend the claim.
    Ask for backdating on your form, as this rebate will only apply from when you make a claim for it.

But now he's off to Australia for his gap year, and the council say I still have to pay 100% council tax, even though he's out of the country. This seems wrong! Anyone had any experience of this one?

    Its a common issue caused by the rules on 'sole or main residence' and 'intention to return'.

    Effectively a property will remain your 'sole or main residence' if you have 'intention to return' at a date in future - even if you work or travel abroad. Because it is deemed to have remained his 'sole or main residence' there are 2 occupiers of the property and no discount can be given.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    but he may change his mind?
    what if he said that he had no intention of coming back, and she claimed the 25% discount and then he changed his mind?

    this seems like a very difficult rule to enforce?

    Once your son's JSA comes through he'll be able to make up the money that you've lost.
