A question's come up on another board that I'd like people's opinions on.
If someone who's received DLA mobility before the age of 65 (I know they can carry on getting this after 65) then develops care needs, can they then get AA as well?
I started to post that it wasn't possible and then deleted my post because I could see that, logically, I could be wrong about it.

I think they possibly could,because there is no mobility component with AA.
Just a guess though, it will be interesting to find out for sure.(AKA HRH_MUngo)

I think this was discussed a while back, can't remember the thread!
I'm pretty sure that it is possible, but quite rare as few people qualify for DLA mobility without also qualifying for care.
(That makes sense in my head, but when I say it outloud it doesn't!)

I also would imagine this would be rare,it would probably baffle even the DMs0

No, they would apply for the care component of DLA. If the care needs where present prior to 65th birthday then they could be considered for any of the 3 levels, but I the care needs occurred after the 65th birthday they could only be considered for either middle or highest rate0 -
If an over 65 develops care needs and already gets mobility DLA, then they can get care DLA (but only at middle or higher rate, and only after having care needs for 6 months rather than the usual 3). It's essentially AA but it's called DLA if you see what I mean. para 61584 of the decision makers guide covers this0

This is correct, have found the relevant bit in the DMG!

I answered this on the silver savers also.
The section 61584 does not deal with the question.
It says
People entitled to a mobility component on their previous claim or before the
revision or supersession can be entitled to a care component at the highest or
middle rate if they develop care needs and satisfy the care conditions at 61462 and
61054. But, they must complete a six month qualifying period before becoming
entitled to the care component1.
It deals with the award of the DLA (care component) before age 65.
If you receive DLA (mobility component ) prior to age 65, it continues after that date, and then develop a care need after age 65, you claim AA, not the care component of DLA.
If care is required before age 65, then DLA (care component) is claimed and the entitlement continues after age 65.
However, if care is required after 65, you cannot claim DLA and AA must instead be claimed.
Although not common, as DMG24 says, it is possible, and I have seen quite a few examples. There is an example on the silver savers board at the moment.
