What are my rights with Argos?

Hi, im not sure this is the right bit to post but couldnt find any other place it would be relevant. 2 Months ago we ordered sofas from Argos in the sale, a large leather sofa and recliner chair for around £483 in the sale. We were expecting delivery within 28 days as stated in the catalogue. The first date i was expecting a call by, they never phoned, i called them, they said i will next be contacted by 2nd Aug, a month after i had already waited a month as they were having trouble getting the large sofa from the suppliers. 2nd Aug cam and still no phone call, i had to phone again and they said the sofa is still delayed and i would be contacted by the 16th Aug. They have just phoned saying they cannot deliver them as they are now out of stock! I have been waiting just over 2 months for these, its our first flat so we havent had sofas for 2 months, they offered me a refund or 20% off ordering other sofas. If i ordered sofas similar to the ones we wanted with the 20% off we would have to pay an extra £200! What are my rights? should they supply me with the next best thing similar to the sofas i ordered at no extra cost? I am just so angry as we have been sitting on the floor for the last 2 months! Hope someone can help, thanks Emma

    They don't have to reduce the price of anything, you're lucky to be offered the 20% off.

    The choices that they have offered you are about all you can expect.

    Based on my experience with Argos sofas, you'd be better off taking the refund and going to DFS instead. Argos sofas are of a very poor quality, and will probably last you a couple of years at best.

    well i would have thought that when you are in a contract of sale they are obliged to give you the item you have paid for, and i wouldnt have thought it would have taken them 2 months to tell me they are out of stock. And we can only afford sofas from Argos, DFS are very expensive and we dont have any savings as it is our first flat.

    Have you had a look at Ikea for sofas ? Had some from there and they are cheap and functional.

    I don't think I can post links yet - but give sofasofa's website a quick look. They actually supply some of Argos's catalogue sofas, but have a bigger choice, and you cut out the middle man which means savings.

    You're legal rights are that you are entitled to nothing but a full refund or supply of the original sofas you ordered. Anything else given by Argos is solely at their discretion as a gesture of goodwill which is exactly what you have been offered in the discount.
    In your position I'd be quite angry too and would write a letter fully outlining your complaint and your expectations of a further discount, but remember they are under no obligation to offer anything further.

    Yes, thats the one! We bought two sofas from them years ago as a bit of gamble (as we've never actually seen them in the flesh or sat on them).

    They delivered within a week or so, and the quality was outstanding. 5 years on, and they still look brand new. The small print says that if you don't like them when you get them there is a 14 day cooling off period when you can return for a full refund less the delivery charge (which was £25 at the time).

    If you live near south Wales they have a showroom in Cardiff.

    Just a recommended option if you are considering buying sofas online.

    Just to add my comment to this, Argos have done exactly the same things to me.
    I called got them to confirm stock before ordering, called them every week to check progress. (I had heard how bad Argos were.) Kept being told it was coming in and they could give me full details 5 days before the end of the 28 days. Called them at that time, was told it was delayed two weeks asked them to explain why, "oh, sorry the buyers aren't in, we'll call you back." Two days later "Sorry, we have no stock, we will not get anymore." E-mailed and asked what they thought they were playing at. Reply was "we'll have more stock in November". Emailed back for confirmation, "no sorry, we won't get anymore stock in."
    I suggest a quick complaint form at Watchdog would be good. It doesn't take long..... any company that takes your money, sits on it, then doesn't supply the goods should be made to pay out compensation. The fact that money has changed hands should make that a binding contract..... (which Consumer Advice have advised me it should be, no matter what the Argos website says.)
    I will never use them again........ appalling!!!
