Gas testing certificates?

The cooker was last tested in 2006 - it clearly says on the green and white label next test is due in 2007.

The boiler does not have one, nor does the gas fire in the living room.

The smoke alarm does not work .


What do I do?

    The above are handy links about the landlord and tenants responsibilities and how to escalate non-compliance. (I believe that the annual test covers boiler and all gas related appliances, therefore as far as I am aware the one certificate could cover all so the presence of a sticker could just be the practice of certain engineers).

    Have you changed the battery in the smoke alarm to check whether that is the issue or is it a wired in alarm?

    The landlord isn't returning calls.. despite me and agent getting onto him.

    I shall contact the HSE and see if they make him move his backside, and the environmental health can come and take a look at the exposed soil stack :mad:

    Don't phone, if you have a problem with the property the correct protocol is to write a letter. I would send a copy to both the landlord and letting agent recorded delivery.

    Your LL could be looking at several separate court charges for contravening the gas safety regs - a prosecution can be brought by either the HSE or the local Council ( try both the EHO and the TRO (tenancy relations officer) on the sector rentals team)

    Failure to get an annual check done x 3 ( boiler, cooker, fire,)
    Failing to obtain a gas safety certificate
    Failing to provide a T with a gas safety cert
    Failing to keep gas safety certs for a min of 2 years ( because what he hasn't had done he can't keep)
    Possibly failing to mainatin the appliances in a safe condition

    He will have failed to comply with his LL insurance company requirements and possibly his S11 repairing obligations which require him to keep heating systems in good safe working order.

    When did you move in and when did you first notice that the smoke alarm wasn't working? Was it not tested in front of you by the LA/LL? It's usual that Ts are expected to check/replace batteries or the back up batteries if the smoke alarm is hard wired.

    This one comes partly under HHSRS (Housing Health & Safety Rating System), and again its one to discuss with the TRO.

    Here's a fairly recent prosecution under the Fire Safety Order - obviously the requirements were those for an HMO, but its a clear indication that the courts will deal with LLs who fail to adequately protect their Ts.

    Two immediate things for you until your LL has had his behind properly kicked :

    *get yourself an audible carbon monoxide detector from the orange and grey DIY place tomorrow.

    * the local Fire Safety Officer can arrange a free check of the property and, in some areas, may offer a free battery smoke alarm.

    The reality is that he will probably be served with a Notice first, requiring him to get the work done. IMO any LL who fails Ts in this way should go straight to court.

    Keep things in writing, and keep copies.

    Thank you. I am so mad about everything in this property and the way I have been treated., I really want to get him straight to court for all the upset and of course rent and deposit back.

    I am so tempted to move out on Tuesday, I have a signed inventory which states the house was in a disgusting condition before I moved in... and have photgrapshs.

    He was supposed to contact me on Friday but never did :)
