Got majority of charges back from BOS - THANKYOU MARTIN!

Because of this site, i found the consumer action group. I took their advice on letters to the bank.

I was getting charge on charge, and i was getting in a loop. Each charge was adding on to the stress.

I got a phonecall from BOS this afternoon. Friendly person said they are willing to give me a maximum of £127 from the £292 (at the time of 1st claim £264) - i said it was a nice offer but i am not going to accept it. I knew that i could have taken the bakn to court and got all the money back. She then went on to talk about the legality of the fees - and she said that they were legal, i claim they are not. I went on to say that i would not accept £127 because it was such a low sum compared to what i could get at court. She then went on to say she would be willing to give me the maximum of £200 (I thought the max she said was £127 ;) ). On this i said £220 and reverse the other charge, she said she could not go that far. I could tell things were starting to go cold on her half, as if she was about to call defeat and stop communication and allow it to go to court. I then said i would accept £210 plus the pending charge to be reversed. She agreed. So thanks to this site and the advice i was given, i didnt have to go to court and i was given back a fair part of my money.

I know i should have went all the way but i was nervous incase they said no in court.

I can say, if it happens again, i will NOT hessitate in taking the bank to court over the ILLEGAL bank charges.

So out of the £292 i got back £210 and also one charge pending reversed and also a company that is owe me money due to a fee will pay me £58 so overall, i am only out of pocket about £24 so i am not going to moan.

So to all those who have been charged illegally, send in a letter to the bank, and DONT give up. you WILL win as the bank wants to keep you as a happy customer.

    Good result.

    Personally I would have held out for the lot, they will not go to court, as they, in my opinion (and that of the OFT) would lose.

    She may have put the phone down then, but their solicitors would soon have instructed them to pay up!! Of that, I'm certain.

    yeh, i was at a crossroads though, of do i wait for the other £24 and wait 3 months or more, and the hastle of court, if it was less than £200 i would have waited and took them to court :D and i will take them if they do it again :p

    i was quite suprised earlier on. I got a letter from the bank, to sign and send back in acceptance of my £210, on the letter it said £238 to get back, but never said about the pending charge removal of which she promised on the phone. She also promised £210. Now, i assume that the £238 includes the £28 pending charge BUT it did not say this on the letter. Should i beable to, through this tecnocality get both £238 AND the charge removed? I think i should. I added to the top of the letter about her promising the pending charge to be removed aswell, so i hope that she does go with her word and give me £238 back and the removal of pending charge.

    If she does not agree to this, then should i take it to the next stage, of the 2nd letter and then court? or should i accept it still?
