Changing a childs name

Hi,

This isnt a money saving question but I'm hoping somebody can give me some info who may have experienced the same issue.

I recently married my beautiful wife. She has taken my surname.

She has a 3yr old daughter who has my wifes maiden name.

We would like to change her daughters surname to the same as ours.

How would we go about doing this and would we need the agreement of the childs father (which is highly unlikely)?

Any Info appreciated.

    You can use whatever name you like (but have her proper name on official documents) - so at school she'd be entered as Amy Jones known as Smith - but in the registers, letters home etc she'd be Amy Smith

    You would need agreement from her father to do so otherwise (or go to court) - someone I know who is going through a similar thing says she is waiting till he has had no contact for 7 years then she can do it under the issue of abandoment (child uses her surname day to day)

    I take it the father is named on the birth certificate. it may be worth getting some advice from the citizens advise as im not sure if she would needs his permission if he isnt named on it :-)

    As I understand it (and I have been there) If your wife was 'married' to her daughters father, then to change her name, permission from the father is required. I on the other hand, if they weren't married, then a name change is possible without permission, unless a Parental Responsibility Order is in place.

    If permission is needed and given its then just a case of making an appt with a solicitor for a change of name deed (at least this is what I did with mine). Very easy to do

    Because the OP said that the little girl had the mothers maiden name i presumed they werent married unless the marriage took place after the little girl was born of course. Does this make any difference.

    Depends when the child was born.

    My daughter is almost three and her father is named on the certificate. As it is, he has equal parental responsibilities, even though we were never married. I would need his permission to change her name to mine. She is known as my name :)

    Childs father is on birth certificate, but he has only been added on within the last few months.
    My daughter is July 06 and it changed the year she was born, can't remember when though? I'll check for you.

    I don't think it matters when he was added? As long as he's there, you'll need permission :(

    In Scotland, the Family Law (Scotland) Act 2006, which comes into force on 4 May 2006, confers parental responsibility and parental rights on unmarried fathers where the father is registered as the child's father. However, it only applies to unmarried fathers who are registered as the father after 4 May 2006.

    The law in relation to parental responsibility has recently been revised. For a child whose birth was registered from 15th April 2002 in Northern Ireland, 1st December 2003 in England and Wales and 4th May 2006 in Scotland, both of the child's parents have parental responsibility if they are registered on the child's birth certificate.
    It depends where you are.

    If you're in Scotland then he won't share parental responsibilty. If you're in England, Wales or Norther Ireland, then it's most likely that he will have parental responibility for the wee one.

    You're best bet is to see a solicitor - most offer a free first visit.

    It was December, but yes you're right - it was 2003 in England.

    I hadn't realised it was different when I posted originally :)
