back dating DLA

    It would only happen if you appeal the original decision and, if that was unsuccessful, went to a tribunal to put your case.

    Each claim is looked at by a DM, and if you happen to have got a harsh one first time round or a easier one this time.
    If you want the earlier claims accepted then you should have/will have to appeal against the refusal, with part of your reasons being that your condition has not changed and you have been accepted later on.

    When you are turned down for dla you have the option of appealing within a month. If you don't do this then you lose the right to appeal. Short extensions can be given if there is an extremely good reason why the appeal could not be made within the time frame.

    Dla is paid for the care & mobility needs a person has & not the condition so the reason you were turned down previously would probably have been that the forms were not filled out properly to demonstrate what your care or mobility needs are.

    When you were turned down previously did you ask for a statement of reasons?

    Did you take experienced welfare rights advice in getting the forms filled out for your previous applications? How the forms are filled out is very important, as is good medical back up.

    Many people have to go through mulitiple applications before a successful dla claim is accepted & it's not possible to have the claim backdated unless you have actually appealed the previous claim.

    So the answer to your question is yes you are pushing your luck in expecting to have your claim backdated to when you made your very first claim. My advise is to just be thankful you have now got a successful claim, which I hope is for a decent duration.

  • I cant see any circumstances under which it would be back dated in the way you wish,as already said you should perhaps be pleased that it has been awarded this time.

    DLA and the Tribunals service both have a 13 month absolute time limit. Once you past that you cant do anything about it.

    hardly it wasn't introduced until 1991....attendance allowance 1971...mobility allowance 1979.
