Hi all,

Ive been lurking for a while now and know this site to be extremely helpful so here goes:

(this is a long post so the weary may want to walk away now)!!:D

Back in '07 I owned my own home, had a good job, great GF and a happy life. I ended up losing my job, got into a large amount of debt, lost my house and my GF (for a while) and ended up homeless for two years.
Anyway, Im back living with my GF at her flat that she currently rents (she took pity on me), I am now unemployed again, like the majority of the country by the looks of it;) and I have now decided that now is the time sort my finances out and make a fresh start in life.

Here is the current situation:
I went to see the local CAB about my debts, I was told that before they could begin to help me, I had to obtain my credit file.
I got my Equifax file with ease but obtaining the "correct" information from experian took the best part of a month! (everytime I received it, it didnt contain any debt at all! this has now been rectified).
I have now taken my files to the CAB and have a date with a debt advisor this friday (5th June). I have been asked to bring proof of my JSA entitlement, my credit files and proof of household income and expenditure. Now I assumed that because I am not the bill payer (I just hand over my JSA to my GF) and it is ME that is going bankrupt, why am I being asked to present documents related to my GF's income and monthly expenditure etc.
Does this mean that my GF will also have to declare bankruptcy too??
She has already filled out a "finacial disassociation" form with experian and they have confirmed the disassociation (due to the mortgage we held together).
Is this correct???

Can anyone please advise me on this situation and if it is the "norm".

Any questions you have will be appreciated also.

Thanks in advance guys!!

no she wont if the debts are in your name , if you go bankrupt while on benefits you will avoid a three year ipa as well

Hi, I thought as much, all the debts are in my name but I still dont understand why the CAB want the household income or SOA when she isnt responsible for any debts!!
I dont want her to be accountable for my debts after bankruptcy!!
Also, I will avoid an IPA but if get a job within the period of bankruptcy, Im guessing that I will have to declare this and will then have to pay a 3 year IPA. Is that correct??

its not about so much what your partner earns they want to know but how much they pay into the house's expenses and your BR has nothing to do with your partner and no they will not have to pay anything towards your debts and yes you do have to tell the OR of ANY changes whilst BR but if its not a great paying job you still may not get an IPA.

    Really appreciate your reply.
Can anybody give me timeline from going in to see the CAB advisor and actually getting to court and being finally free and BR!! A month maybe??
Im aware that the amount of BR's have skyrocketed and I know I may have a wait on my hands but its always nice to have an idea of a timescale if you know what I mean??
Im an electrician so my wage would be kind of OK is guess so I would lose a fair bit of that if I finally managed to find work!

Im from Salford in Manchester if anybody is aware of the local court by the way???

problem is as you say the increase in BR's have gone through the roof of late......no 2 courts are the same i'm afraid...some courts offer a walk-in service some appointments only

so after your CAB appt you could be looking at anything from a few days to a few weeks

    Find your local court here
