what do I do???? MBNA letter today "YOU ARE NOT COOPERATING WITH US"

We have started a DMP with CCCS - 1st payment due out on 1st May. We have contacted all our creditors as advised stating we are now clients of CCCS etc etc, sure by now everyone knows the procedure.

I have today received a letter from MBNA - despite the fact I have written 3 times and spoken to them by phone, as follows:-

"You are not cooperating with us"

We have made several attempts to contact you without success. We have sent letters and made telephone calls but as yet, you have not made contact with us. etc etc etc.

What am I supposed to do they are blatant liars - do I get in touch with them direct or do I send a copy of the letter to CCCS or do I ignore it?????????

Dont know what to do any advice gratefully received. We are already fed up with the whole thing and cant see any lights only dark gloomy tunnels. Dont know whether we can cope with all this.

    Sorry to say this is just the way Mbna runs its company i had over 100 letters from them in 8 months it took me to save and go bankrupt,I know they make you feel bad i hated the way they made me feel Just keep a copy of everything you send to them,its worth sending yet another letter to them yet again give them all your Cccs details and then when you feel like it call or reply to the further letters you will get ,for my part they made me get to the stage were i taped all phone call i either made to them or recived it was the only way i could prove the various dubious methods they used to try and get me to pay more than i could afford.
    I must add i made them fully aware i was recording the call but it did not stop them!!
    Remember You are doing the right thing your trying to sort out your life you should be respected for that no matter how you got in to trouble
    I had 13 creditors 3 of them were with mbna/abbey they were the only company to give me a hard time and in the end i did get one over them as they sold one of my debts on after i went bankrupt very naughty but as i had proff they new about the refunded the DCA and wiped it from my balance!!

    :grouphug: Tough time at the moment but it WILL get better!

    Have you contacted CCS about this letter from MBNA? I think that would be a good idea. Also have you kept a record of when/who you spoke to at MBNA? Copies of the letters you sent them?

    I know it seems like a battle that never ends but things will improve. Just hang in there.

  • Thank you - have decided to send a letter asking them why they have ignored my letters and tel calls and then sent ME a letter and that if they continue to harrass me I will monitor all calls and correspondence and take the matter further... eeek - very brave of me!!

  • yes pay what you can afford comunicate by letter only, ignore phone calls make your payment on time they cant do anything its all hot air as long as it is unsecured dont worry, if they over step the mark report to oft if dca get involved complain to the original creditor about them ,debt collectors on your door step are rare if they turn up tell them to bog off and escourt them down the path if need be

    You should make a copy of all correspondance from them and then send the originals to CCCS to deal with. Stop replying to MBNA now, let CCCS deal with it.

    Same with me, MBNA were the worst to deal with. I got lots of those "not co-operating" letters, two very nice postcards with hearts on the front saying I will be called on in person within the week, (never did - in fact when I rung up and asked for the persons name on the card I was told she was on holiday!). The advice I got was to just ignore them, but I did answer the phone calls and I just asked what they had on their screen. When they told me I then just said nothing's changed since this morning/yesterday and hung up. I did record every phone call though and have still got them. One poor girl from a debt agency, when told her I was recording her, she went absolutely ape, shouting at me saying I can't record her, so I asked what she was going to do to stop me, she then just hung up on me!
    In the 10 weeks or so it took to get the IVA accepted I had over 3" thick worth of letters which I took out to my garden waste incinerater and burnt as soon as I knew the IVA had been accepted.

    send them a photocopy of the not co-operating letter stapelled together with photocopies of all the letters you have sent them. put a covering letter simply saying please see enclosed for your records and then send it recorded delivery.

    get a diary and if you ever have to speak to them by phone note in the diary the date and time of the call and whether you made it from your home, mob etc. Ask the person you are dealing with for their name and write this down too. this way if there is any dispute you can prove by your phonebill that you made the call.

    YOU HAVE BLATANTLY IGNORED ALL MY CONTACT WITH YOU

    Please tell me why you have sent me the letter enclosed which is a complete and utter lie.

    I have attached copies of the two letters i have already sent to yourselves. I have also rung you and you have now sent me the attached letter which is completely untrue. I have made contact with you by phone and by letter so I find it utterley disgusting that you send me a letter implying I am ignoring you.

    As ytou will see from one of the letters attached I am now a client of CCCS and as I hope you will appreciate am trying to get my financial situation under control with the help of the CCCS.

    I do not enjoy being in this situation and getting letters like the one attached is just bully tactics and will not help in any way.

    Therefore, please accept the fact that the CCCS will be contacting you and forwarding payments to you on my behalf.

    In the meantime I have been informed that MBNA are totally unsympathetic and use bully tactics and as such I will now be recording and monitoring all correspondence between us and will take the matter further should you harass me in any way.
