OMG!!! MBNA Visa (£100 deposit card) they are keeping the £100 deposit!!!???

Some of you will remember that MBNA offered a Visa credit card with a £100 deposit? This was offered to people who applied for a regular card but did not meet the credit score.

Anyway, fast forward 9 months... As my credit is now much better, I have just applied for & recieved a Barclaycard Gold with a good limit and free balance transfers for 6 months so I transfered my balance from MBNA to the Barclaycard a few days ago leaving me £2.91 in credit.

So.... I just called MBNA to close the account as the APR is shocking, my limit has never increased and to get my £100 back to be told "sorry sir as you went over your limit on the MBNA card in previous months you do not get the £100 deposit returned, it's in the terms and conditions"

I asked to speak to a manager but she was not available but will call me back in the next 24 hours, I also asked them to read me out the section in the t's & c's that states this but the advisor didn't have them and said a copy would be sent out to me in the post.

SURELEY they cannot do this????!!!??? :mad:

    Was it in the terms and conditions? I trust you read them before spending on the card?

    I don't know, but it wouldn't surprise me that a breach of ts and cs (ie late payment or over credit limit) would lose you your deposit. Sounds crap, but still quite likely.

    If you did breach the terms and conditions, I would follow the guide for reclaiming credit card charges and question as to if £100 is a genuine estimate of their costs relating to you breach and if the term permitting them to retain it is fair under the UTCCRs.

    Chances are they will back down as £100 is ludicrous

    Yes I skimmed through the T's & C's when I originally recieved the card, do not recall any mention of the deposit at all, never mind them keeping it! Interestingly, I actually called them a couple of months back as I was under the impression the £100 would be returned after a few months, their reply was that it would be retained until the account was closed.

    Are you for real? I have paid the balance in full, have paid their interest for the 9 months I used the card and paid the £12 fee for the one time I did go over the limit... How on earth do you come to the conclusion that the £100 is somehow theirs?? :confused::rolleyes:

    You went over the limit, they don't have to pay it to you as officially you breached their T's & C's by doing that. I had that with a Virgin card when they lost my payment and then immediately put me into the "no longer eligible for 0% interest". They eventually conceded it was their fault as they "lost" my payment but this happened for 4 months in a row, each month I had to ring up and get them to amend it and finally I took my business elsewhere. It is a nightmare but even if yo upaid the fee, you breached their rules and regulations for the £100.

    I think an official complaint should secure your £100 deposit back. You also have the option to take the case to the FOS (Financial Ombudsman Service) after 8 weeks should you not be happy with the outcome.

    Ignore the bank employees (or perhaps just bank apologists) who will always side with the bank at every opportunity.

    How is a £100 deposit the bank's money? It is just that, a refundable deposit. He was charged for going over limit the £12 that is allowed. For the bank to take HIS £100 is just fraud.

    This sums up the position very neatly. I think it is especially true given you have paid the £12.
