A bit long but hear me out.

First Parts 4 U Car Accessories & Parts,Chorley Lancs advertised a side door for a vito van (ebay item 380122732210). I rang them up and asked them if they had the rear doors and they said yes. I told them I needed perfect doors as I am doing one up (it's a private vehicle and I am not a trader). I was quoted a price of £175 per door so that makes £350 (no mention of VAT or anything). I also tried to get them to quote for other parts but these were not available but this is just an aside.) On the basis of the doors being in good condition he put me through to their accounts and I asked about delivery, she told me that they only pass on the cost of the courier but couldn't give me an exact price. I gave them my debit card number (they charged 5% for credit cards!) and they promised delivery Wednesday.



So anyway, they took a shade under £500 from my debit card (at this cost I was expecting the doors to be delivered on a silk cushion embroidered with gold braiding). I rang them on Wednesday to ask where the doors were and they were not even removed from the van. The said friday so I picked them up today and they are from a different van and are in worse condition than my existing doors. No invoice, no delivery note, nothing with the doors.



I want to reject these, I am a consumer, not a trader so what's my rights? I plan to go on Monday and have 'a chat' with them.

surely distance selling and unfair trading regs apply?

Thank god it's the weekend as I would otherwise be there now having totally lost my cool.

I feel a bit naive to be honest - why does everyone in the motor trade seem to be dodgy.

    Yes, I suspect you are okay under DSR, others will confirm but essentially you offered a price which was accepted and didn't go via auction.

    You say naive, I'd say I'd totally agree. The ad clearly states that prices are subject to VAT, and the seller has a shockingly low approval rating of 66.7% and only 32 trades. Instantly, it suggests trouble big style but these are the lessons one learns the best from, i.e. experience, it has a way of etching itself into your subconcious!

    But nevermind that, the users payment preference is paypal, i.e. protection. When you said debit card, I assume you paid outside of paypal, it would cost you no more and you'd get free protection. I'd ask ebay about his 5% credit card charge, its not cited up front but then again, if I'd seen a 67% approval rating, I'd be weary about just about everything.

    DSR may save you - going to "have a chat with them" would not be advised in my book.

    If you want to report them to eBay they are breaking at least 1 rule.

    As eBay is primarily a consumer marketplace, from February 20th 2008, users will no longer be permitted to add VAT to the final item price after the item has been won.

    ....if the op bought them off ebay which he didnt so no dice
    Back by no demand whatsoever.

    The goods are not 'as described'. As such the traders are in breach of contract.

    This would apply whether you were a consumer or a business.

    Forget DSR etc, it is irrelevant.

    You wish to reject the goods and claim a full refund. You'll be lucky!

    This will probably require a trip to court through the small claims procedure.

    That's actually £25 (MB inc vat £294.07) more than a new one would have cost from your local MB dealer!

    And your £500 a pair rear doors are £196.26 each inc vat from MB.

    So you've managed to pay over £100 more than brand new MB doors would have cost.
