After getting so much fantastic advice last week on Business Insurance,

(Thanks again Matty Moo and the rest.) I am back with more questions.

Well I spent a long weekend creating websites and writing my Terms and Conditions and want you good people to have a look and tell me whats right and wrong.

I have used a combination of templates from the web, advice from friends and looking at Terms and Conditions from other people doing Computer Repair / Support.

Would anyone out there spare me 5 mins to have a quick look at them and see if I missed anything or made any big mistakes.

I have posted it below, but if thats not allowed on here, tell me and I shall remove it.

Any Feedback gratefully received !! Am due to go live on the 16th April and getting both excited and nervous as the day approaches ;-)

Not sure if it makes a difference to the T&C but here is an outline of what I do, Iam a sole trader, am NOT Selling new Pcs or Laptops, just providing Support / Repair / Training, no Shop Premises, customers base is mostly home users or very small businesses. Am just charging an hourly rate, Not Vat Registered. Any other info you need just ask.

Terms & Conditions

The following are terms of a legal agreement between you and ARL Computer Services and its associated companies. By accessing, browsing and/or using any service advertised on this site and the server it's hosted on, you acknowledge that you have read, understood, and agree to be bound by the terms below and to comply with all applicable laws and regulations. If you do not agree with these terms, don't use this site.

1.Website Usage
1.1 The content of the pages of this website is for your general information and use only. It is subject to change without notice.
1.2 Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

2. Definitions
2.1 In these terms and conditions the word 'Customer' refers to the person, entity, firm or company ordering products or services from ARL Computer Services.

3. Contract Information
3.1 All order or appointment requests submitted by the Customer to ARL Computer Services and accepted by ARL Computer Services shall be subject to these following terms and conditions which shall form part of and govern any Contract.
3.2 Usage of any service or receiving any estimate or quotation for any Products and/or Services by the customer, issued by ARL Computer Services -verbally, by phone or in person or in writing including by email- shall be deemed acceptance of these terms and conditions.

4 Authorisation
4.1 The customer authorises ARL Computer Services to conduct an evaluation of the equipment/media to determine the nature of the problem and provide an estimate for the repair cost and time it may take. The evaluation is charged at our standard hourly rates of £25/hour 10am-8pm £50/hour 8pm-10am and no work beyond this evaluation will be charged without explicit customer approval.
4.2 The customer authorises ARL Computer Services and its employees to receive and transport any computer equipment, other equipment, media or data to and from their facilities.

5. Legal Rights
5.1 The customer is the legal owner (or authorised representative of the legal owner) of any equipment, data or media given to ARL Computer Services.
5.2 Any property left with ARL Computer Services unclaimed for 90 days, will be disposed of. At which time, ARL Computer Services shall have no liability to the client or any third party.

6. Price
6.1 All prices for Products or Services stated in any quote, estimate or acceptance of order are those current at the time of the Customer's enquiry by phone, by email or any other acceptable means.

7. Payment
7.1 Payment for parts and services must be made by cash, cheque or internet bank transfer upon the delivery of the services by ARL Computer Services.
7.2 The customer agrees that payment for services and carriage is non-refundable and parts or equipment fitted or supplied will be replaced only if found faulty and/or covered by the manufacturer's warranty.

8. Limited Liability

8.1 ARL Computer Services shall not be liable for any claims regarding the physical functioning of equipment/media or the condition or existence of data on storage media supplied before, during or after service.

8.2 ARL Computer Services will make every possible effort to preserve their customers' data, however they make no guarantees whatsoever that data will be intact after the computer(s) / equipment have been repaired and tested. The customer agrees not to hold ARL Computer Services responsible for any loss or damage to data as a result of repairs, upgrades or any other services carried out on their computer(s) / equipment or network.

8.3 In no event will ARL Computer Services be liable for any damage to computer equipment, property, loss of data, loss of revenue or profits, or any special, incidental, contingent, or consequential damages, however caused, before, during or after service even if ARL Computer Services has been advised of the possibility of damages or loss to persons or property. ARL Computer Services's liability of any kind with respect to the services, including any negligence on its part, shall be limited to the contract price for the services.

8.4 The customer is aware of the inherent risks of injury and property damage involved in laptop/desktop repair, including without limitation, risks due to destruction or damage to the machine, media, or data and inability to repair the machine or recover data, including those that may result from the negligence of ARL Computer Services, and assumes any and all known risks of injury and property damage that may results.

8.5 Any advice or recommendations given to the Customer by ARL Computer Services or its employees as to storage, application, use or preference of the goods is followed or acted upon entirely at the Customer's own risk and accordingly ARL Computer Services shall not be liable for any such advice or recommendation.

8.6 While ARL Computer Services will make every effort to preserve the integrity of any equipment under repair, the Customer agrees not to hold ARL Computer Services responsible for any accidental damages to the equipment in its possession including but not limited to surface scratches, deformations and cracks.

8.7 The client and ARL Computer Services agree that the sole and exclusive remedy for unsatisfactory work or data shall be, at ARL Computer Services option, additional attempts by ARL Computer Services to recover satisfactory data or refund of the amount paid by the client. The parties acknowledge that the price of ARL Computer Services services would be much greater if ARL Computer Services undertook more extensive liability.

9. Confidentiality
9.1 ARL Computer Services agrees not to disclose any information or data files supplied with, stored on, or recovered from client's equipment except to employees of ARL Computer Services and where required by law.

10. Warranty
10.1 30 days Limited warranty on laptops/desktops that ARL Computer Services has repaired, ARL Computer Services makes no warranty on data, express or implied, and ARL Computer Services disclaims any data warranty of any kind. The client and ARL Computer Services agree that the sole and exclusive remedy for unsatisfactory work or data shall be, at ARL Computer Services discretion, refund of the amount paid by the client.
