Section 75 only for principal cardholder!

From what I gather from Google, while the OFT isn't happy about this, section 75 only covers the principal cardholder, or at the very least it hasn't been tested in court yet so card companies are using this as an excuse. While with some transactions there doesn't seem to be evidence of which card is used, it still seems to be risky business. Strangely enough this seems to have no mention on the forums or this site. Maybe it should be mentioned in the section 75 article?
I'm very glad to have read this because even though I have my own credit cards, it's quite possible I'd buy on an additional card to my girlfriend's Tesco credit card, as that gives clubcard points.

Just to qualify, the court case that brought this to the fore means that if the additional cardholder brought something for their sole benefit.
To quote the case in question
".... was not a joint purchase, and Mr Kettle was not acting as agent for Mrs Kettle, as they were clearly goods which were purchased for Mr Kettle´s use and benefit. ".
Its only in those cases where the purchases is for the additional cardholder's 'use and benefit' alone that you may run into trouble.0 -
Kind of makes sense in that the credit agreement is between the CC company and the principle cardholder so they get the protection. Additional cardholders are assigned by the principle holder and are not credit checked or anything by the CC company so I guess you could say the additional cardholders have a credit agreement with the principle holder and not the CC company?0
