Telephone Fraud - where to go?

We are a business and have had telephone dial through fraud on our telephone switch for £102k.
Our telecomms company are not willing to reduce the cost or meet us half and expect us to pay the full amount.
Our switch maintainer has closed the loop hole now but obviously a bit late.
The calls were made from out side the UK and were to international premium rate numbers in other countries.
This is along shot but does any one have any good advice? Ofcom basically said it's our problem as it was our equipment at fault.

Surely whoever programmed the switch must be liable for leaving it open to abuse like that?Time has moved on (much quicker than it used to - or so it seems at my age) and my previous advice on residential telephony has been or is now gradually being overtaken by changes in the retail market. Hence, I have now deleted links to my previous 'pearls of wisdom'. I sincerely hope they helped save some of you money.0

Sort of. Our current maintainer inherited the system from the people who originally installed it.
There is a clause in their contract which says if they are found liable for any such faults then the maximum they'll pay it is the equivalent to the price we pay for the contract (£5k)
I was hoping there was another way i could approach it from such as forcing the telecomm company to reduce the bill so at least they don't make a profit on the calls.0 -
£102,000? Just checking.
That's just dipped inot 6 figures, ouch. I suppose it depends what sort of business you are, would this put you out of business? Would you like it to put you out of business? Would the people your business owes (BT?) prefer a small amount or nothing? Would giving your case some oxygen in the local papers help? Can you embarass anyone with the !!!! up? Can you afford the full amount (ie could they get it off you via the courts)? Can you change suppliers?
We need more info and then we can maybe help more. And just because you signed a contract doesn't make the terms legal. Far from it. That £5k limit may not apply if they failed to take reasonable steps to check the switch on a periodic basis etc. Most people here don't know (me included) what a switch is but I reckon some common sense and then maybe legal/technical professional help will help. AT the end of the day if you can afford the bill they'll come for it and you will need an expert witness I'd imagine.0 -
for info the switch he refers to is the telecom switch (exchange) located in his business property0
