Hi
This is my first post so hope i get it right.
I got behind on my council tax payments and this was passed to Equita. I agreed a monthly payment to them to pay off the balance. In oversight i forgot to make february 09 payment at the 5th of the month. I received a letter from them on Saturday saying that bayliff had called (not that i know of) and that i needed to contact them to either pay all or arrange a payment plan.
Before i could do this on Monday the baliff came to the door and issued me with notice that he wants all payment by next tuesday or he will take items to sell to pay debt.
On saturday the letter said that i had £544 to pay, but the baliff said its £715 to pay.
I searched on this site for advice and found a letter to send to Equita asking for proof of charges, proof of court order etc. Which i have posted to them today recorded delivery.
What should i do now? Should i contact the baliff and tell him that i have queried it, i tried to speak to someone at Equita but they said now it has been passed over to the baliff that they can't speak to me, only him.
Please help. I could probably just about get the £544 together and pay it but not £715.
Any help anyone????

Hi
we need to know a lot more.
Di the bailiff come into the house?
Did he write a list of your property - levy/walking possesion order?
Did you sign anything?If you've have not made a mistake, you've made nothing0 -
I don't know if you have now made February's payment, but I suggest you make that payment and the one for March asap, and keep making the payments whilst you sort this out.0

No, he only came to the front door and gave me the letter.
He never made any lists that i am aware of.
I never signed anything.
Hope this helps.Debts to deal with Cap 1 £3996.83 £3923.43 (0%), Next £1252.21 £1211.85 (0%) Very £294.88 £282.64, Studio £266.11 £256.11 (0%), Halifax card £277.17 £466.01:mad:0 -
I phoned Equita yesterday and offered to pay Feb payment and on Wed i could pay March payment, but they wouldn't discuss anything with me said i have to speak to the baliff, i asked if i could set up a payment arrangement with him but they said they dont know and to speak to him.
i have put off doing this in case i do the wrong thing.Debts to deal with Cap 1 £3996.83 £3923.43 (0%), Next £1252.21 £1211.85 (0%) Very £294.88 £282.64, Studio £266.11 £256.11 (0%), Halifax card £277.17 £466.01:mad:0 -
Phew
Good. So he has not done a levy/WPO. If he does either of these, then he is entitled to claim extra charges and he can come back into the house to take the goods if you do not pay up.
So from now on, you do not open the door to him or anyone else you do not know.
They can claim for two visits which is a total of about £45, nothing more.
You need to pm Herbie21 and tell her the name of the bailiff involved, so she can check if he is registered to collect CT.
Get as much of the February payment made as possible and then make march on time.
Once you have the charges breakdown, then get Herbie21 to help you write a letter demanding that they reduce them again. And when you do this, make sure you send copies to teh revenue protection people at the council and your own councillors. If you've have not made a mistake, you've made nothing0 -
How do i make the payment for feb and march, do i do this via the baliff? as Equita won't speak to me. ??Debts to deal with Cap 1 £3996.83 £3923.43 (0%), Next £1252.21 £1211.85 (0%) Very £294.88 £282.64, Studio £266.11 £256.11 (0%), Halifax card £277.17 £466.01:mad:0

Hi
Send the bailiffs name to Herbie21 and read this www.bailiffadviceonline.co.uk
Tell Herbie about the situation. I doubt if the councill will be happy to learn that they are effectivly preventing you from making a payment. If you've have not made a mistake, you've made nothing0 -
You need to WRITE to Equita or better still send an e-mail to:
info@equita.co.uk
You need to say something along the following lines.
I refer to the above account in relation to unpaid council tax due to xxxx
As you will be aware from your files this account has been assed to your bailiff Mr xxx to enforce.
The query that I have is concerning the amount that your bailiff is now stating is due. You will be aware that your bailiff visited my premises on xxx and for this visit I am advised that Mr xxx may only charge a fee of £24.50 for "attending to levy where no levy was made". I am further advised that it would appear that Mr xxx is attempting to charge me an "enforcement fee" which is NOT provided for in the statutory regulations unless a valid levy was first undertaken. No levy has been made on my goods and no documentation provided as proof.
As a matter of urgency can you please provide a full and detailed breakdown of the charges made by your bailiff.
