Getting A Refund

Argh! Just posted a long message and it's all gone! Here we go again.

It collapsed Saturday night as one side has appeared to have gone completely. I am not overweight, nor have I placed the bed under any excess strain. I have been left with sore shoulders and pain in my lower back ever since and contacted Argos to try and get a refund as I am loathe to get another one, only for it to happen again (though I have learnt since that it is apparently discontinued, despite being a newish range(!?!?!))

I am not begging for compensation or anything like that, I would simply just like a refund so I can go and get a new - studier!!! - bed from somewhere else.

Hello,

I would like to make an enquiry about a bed that I bought in September 2008. This morning I had a very rude awakening at 3.13am this Saturday morning (31st January) when the previously sturdy bed collapsed underneath me and I ended up landing on the floor.

The bed, as I went to sleep last night, was perfectly fine and in one solid piece. This morning - obviously - it is a different story. The slats across the middle are still in complete order as far as I am aware, except for the one in the middle that was directly under me as I landed, and it appears to be the right hand side that has broken completely, one of the side supports at the head of the bed is now appearing to be pressed against the material and has broken, and the others appear to have followed suit, sending me collapsing to the ground.

Now, with my heart rate returning to normal and my back, shoulders and ego a little bruised I am please asking for something to be done about the bed and headboard with regards to the years guarentee. I would NOT feel happy with a replacement as I fear I would spend more time awake wondering if the same was going to happen so I would appreciate a refund to my argos card if acceptable.

As I mentioned in my original email, I do not wish for the item to be replaced as I have lost faith. I would appreciate a full refund and will return the faulty bed to yourselves in due course.

Hello,
Thank you again for your reply. I understand what you are offering but the bed is not fit for purpose. From my understanding of the Sales Of Goods Act, I can request a refund, especially as it has only been four months.

I am sure you can understand why I am so have another bed from Argos in the place of this one, especially given my rude awakening during the night and the resultant pain I have suffered since. I am considering visiting the doctor as the pain has not subsided any since it happened.

So what now? Am I entitled to a refund or is it just replacement? As I read it it's been less than 6 months so I am?!

I really don't want another argos bed! Full stop! But I can't afford to lose that amount of money.

    From http://www.berr.gov.uk/whatwedo/consumers/fact-sheets/page38311.html:
    If goods do not conform to contract at the time of sale, purchasers can request their money back "within a reasonable time".

    The "reasonable time" is usually around thirty days. So you see Argos are correct that they do not have to offer you a refund.

    If you want a sturdier bed why not choose another from Argos?

    I don't want another from Argos as I'm fast losing faith in their company. We have twice had to replace a dog crate (We're on our third now - which touch wood is lasting) and I've had to replace three dvd recorders (2 warfdale and 1 acoustic solutions in little more than 12 months that were bought from them.

    As well as the above my grandfather (who me and my mum care for) has had problems with a TV bought from there - I'm really not wanting to go ahead and spend more money with them to get a (what would hopefully be) a studier bed just incase it went the same way.

    Argos are well within their rights to offer you a replacement or a credit note at this point, you cannot prove that the bed was faulty so it is hard to claim that it was unfit for purpose as it lasted four months without problems.

    Just take a look through the catalogue and choose something else, there is little else that you can do without getting into a long drawn out process that you will probably lose anyway.

    You mention that you have had 2 Wharfedale and 1 Accoustic Solutions DVD Recorders which have become faulty as well as a TV that your relative has , but an important point to make is that these goods could have also been purchased from Asda, Tesco, Comet, Dixons ect ect they are a make of a product that is sold in several shops, they are not a product that is made an distributed by Argos, therefore these faults that you have had could have occurred at where ever you may have bought them from.
    I have a bed that i purchased from Argos over 10 years ago albeit new mattress has been purchased but the item is fine aswell as other items purchased from there.
    Try to see if they can let you have a more expensive one at maybe a slightly reduced price for the inconvenience you never know you might be lucky
  • Have you tried calling them? You may get a better response from a human than an automated e-mail
  • You could try going into store and see what they say when the store calls Argos Direct?

    I got another couple of emails offering a bed and I replied the same saying I did not want a replacement and I recieved this:

    Thank you for your e-mail regarding the above order.

    I am sorry the item you ordered has become faulty. After reading your previous emails and the same item not being available, I have arranged for the faulty item to be collected and for you to receive a full refund back to your card.

    Please call our Booking Team on 0845 602 7281 to arrange a convenient date for collection.

  • im glad you got your refund - i was shocked they were holding out seeing as you paid by arogs card anyway, its not like you could go and spend that money elsewhere and when i worked there on 'problem' refunds like out of date/no receipt etc we were always told to issue a gift card so they had to spend that money back with argos - which is probabally illegal lol

    and just for the record, my argos £350 bed is useless and all the slats were gone within about 9 months and i weigh 9 stone!!!

    I weigh a little more than you and admittedly this was only about £150 but you still expect things to last longer than 4 months! (and 9 in your case!)
