Chiltern Claims & Hardship Claim

Hi,

Can anybody help? I had a claim in with Chiltern Claims handling for bank charges, and have not been in touch with them for some time due to the cases being on hold. However I was reading a couple of days ago on here about claims for financial hardship and tried to contact them. However the phone number is dead and their web-site does not appear to exist either. Google searches come up blank as well.

Also, if they have gone bump, can I still pursue my bank on the original claim (I have a couple of pieces of correspondance from them on the matter) and put a claim in now due to financial hardship?

    Do you have any correspondance form them? (as this could make it possible to trace them through the authorities).

    If they no longer exist then you can start again on your own terms with no fear of having to pay over a % fee to them. However, if no claim was actually started you can only go back 6 years from the first time you complain (i.e. now)

    Hopefully people reading this will realise the dangers of using these kind of companies. Much better to do it yourself.

    Would it be seen as a new claim as I have corresspondance from Llloyds TSB about the original claim? (this would not be a problem as six years from today would be more than six years from the original claim 18 months ago).

    If seen as a new claim, does this affect it in any way (as it would start after the court case started, etc)?

  • Well, the court case appeal has started now, so you're caught up in that now, irrespective of when the claim started.

    My main concern for you now is that you can't use the Financial Ombudsman if more than 6 months has passed since the bank's "final response" has been issued.

    I suggest you re-complain to the bank saying you now think you qualify for financial hardship, as they will be obliged to consider it afresh.

    As for the reclaims company, I think you have a decent case that they are incompetent if they ever find out you have started claiming again and try and claim their %. They might even have been banned - you'd have to check with the regulator.

    If you signed an agreement with the claims company then they might have become your representative and there is a risk the bank are communicating directly with them - so you may need to check that with the bank as well.
  • Hello, I have also tried today to get in touch with Chiltern Claims with no luck. Cannot find them listed anywhere or get through on the phone on website. I am now going to write to my bank to tell them of the situation and forward all correspondance to me.
    I have being waiting for my bank to deal with this since Jan 07!!
  • Chiltern Claims are still trading but soon to close. They are linked with The Endowment Partnership Ltd with has a Dissolution in place (due to close over the next few weeks) with Companies House. Also, they are linked with Amity Financial ltd http://www.amityfinancial.co.uk/

    I just called them myself as I dealt with them two years back in fact and was told that Chiltern are closing the same way as the Endowment Partnership. If you were speaking with an Ed Boulton, he has now left. The lady at Amity advised to go to the FO and explain Chilterns position and hwere you stand now.

    I also had a claim going through with chiltern claims, bu all I ever received from them was an agreement, which I signed and sent back, and a phone call, so I have no correspondance. how would I go about continuing this claim, or would I have to arrange a new claim?

    You would need to contact them to make them aware you no longer wish them to represent you. However, be aware that if you have signed an agreement which means you have to pay to get out of it, then unfortunately, it will cost you to go it out alone.
