Curry's Whatever Happens Cover "MISOLD"

I took the currys whatever happens cover out about 2 and a half years ago when I bought an LCD TV for £1500. The salesperson assured me that under this cover my TV would either be repaired or replaced within 21 days if anything went wrong. As my parents had purchased a PLASMA TV before me and this failed after just 14 months I thought the cover would be ok by relying on what the salesperson said and as I would not be able to afford another TV if anything went wrong and at £7 a month it was affordable.

Needless to say after 2 1/2 years the TV has failed so after ringing the number on the helpline my claim was started on the 2nd December of this year, with this in mind it should all be sorted and a new TV sat in my room by the 23rd of December so my kids can play on their new consoles and games. The repair man came round and said it'll have to be taken off to be repaired and that someone will ring me to pick it up. I waited and after more than 2 and a half weeks no one rang. So I rang up again on the 22nd and said no one has picked the TV up I would like a new one please to which I got the response of that I have to wait the full 21 days to give them a chance to fix it........they had not even picked the TV up so I said how do I get a new one. The person then informed me that I would receive vouchers for either the same TV or an equivalent specification. After nearly 28 days I am without a working TV and any vouchers and I have just been informed that I will receive only £489.34 back in vouchers.

I am fed up and feel totally let down by all this and the worst thing of all is that my kids have not been able to use all there new games and console bought for them at Christmas.

How do I stand with my rights if I go into the Currys store and demand all my money back (money for the TV and all the money paid for cover)as the TV has gone faulty and also that I was "misold" the Whatever happens cover by the salesperson?

    Although they appear to have dragged their feet in dealing with this matter, how can you say you were 'misold' the insurance when they have confirmed that they will be sending you the vouchers for a replacement? I would have thought that would constitute a successful claim under the policy. The term 'misold' in my book is a term that relates to selling a policy that the customer could never benefit from or didn't need.

    As far as the amount of the vouchers goes, is this sufficient to replace the TV with a modern equivalent? I have had a 42" Panasonic plasma for approx the same time as yours and it cost me £2000 at the time - can be had now for a touch over £600 :mad:. If the policy is providing for an equivalent (or probably better) replacement then surely it is doing what it says on the tin.:confused:

    By all means complain about the time they have taken to deal with it - they may chuck in a voucher, or high quality scart / hdmi lead as compo - but surely the policy itself is fundamentaly sound?

    All insurances will have a clause stating that if it is not "economically viable" to repair then they won't repair it.
    You wouldn 't expect the sales person to read the whole policy to you would you?
    You are meant to read it yourself and you get a cooling off period to do this.

    Sounds like the policy is performing as intended and you don't have a case.

    There is no mis-sale here. Poor admin but not mis-sale.

    You have no rights to that at all.

    As mentioned higher up, you get vouchers to allow you to buy the current equivalent. As the cost of TVs has come down, you would expect to get less.

  • Sorry, the reason I am saying "misold" is the fact that the salesperson sold me the the policy under the impression that the TV would either be repaired or replaced within 21 days, yet 2 and a half years later when I come to claim they say they I have to wait 21 days to repair the TV and if not then issue vouchers which can take upto another 7 days. 28 days later and the matter has clearly not been resolved as I don't have the vouchers in my hand, yes they may have all the T&C's written down. But I thought that this was maybe similar to the banks miselling loan protection?? In the sence that I was misled to believe that everything would be resolved in 21 days and it is clearly not the case. I even asked at Curry's and the manager admitted that they perhaps were miselling this product n the earlier years and it has since been refined.

    You may be technically right, but it is Xmas which means the post is not operating on bank holidays.
    If you get your vouchers albeit a few days late, I doubt very much that any complaint would be up held.

    Did you ask them if they could lend you a set in the intervening period?

    Which is technically correct. It couldnt be repaired and the model is probably no longer in manufacture. In which case a replacement is offered with vouchers to the value of the equivalent. If you feel the vouchers dont add up enough to match the spec of what you had then give them your examples and costs and ask them for more to match those.

    Not really. payment protection had issues regarding the APR and if you were forced to have it as part of the loans. Personally, I think extended warranties are a rip off but that doesnt make them wrong. They used to give the hard sell on these and no doubt went too far at times but nowadays they dont appear to do that (and I have bought a plasma, LCD TV and a washing machine in the last 3 weeks and put it to the test).
