If a tenant who has been a month in arrears for the last few months, told you that the rent due next week will be late because their bank account has been cloned and is now frozen, would you believe them?
Or would you think that the rent money has been spent on Xmas?
Good tenant, except for these rent arrears and often paying rent a week late.
Am tempted to issue notice with covering letter that the notice will be withdrawn if rent materialises be mid January. If the bank account has really been attacked then its pretty !!!!!! for this to happen just before Xmas and I feel a bit mean issuing notices. If on the other hand I'm being taken advantage of yet again, this really could be the last straw.

Did they let you know straight away that they couldnt pay the rent last month? I would say its good that they told you before it was due for this month - i guess it comes down to whether you feel they are a trustworthy tenant?
My friend had his card cloned and bank account frozen and it took about 3 weeks to sort out - the only way he could get money out was by going into the bank everyday and couldnt withdraw more than £20 a day!! A nightmare for him!!£2 Savers Club #156!

The rent isn't due until next week, so I have been informed in advance.

If they are already in arrears and have paid rent late regularly then I'd be inclined not to believe their story and would come down hard on them. I'd want evidence of their account being cloned. If they produced that and it was true then I'd be more lenient.
However, gut feeling, I think they are telling fibsWhat exactly are they doing and what exactly have you done in respect of addressing the existing arrears/late payments? A clear payment plan should be in place.
I'd be serving a S21 unless they produce some concrete evidence of the cloned account and are making efforts to repay the arrears. Sometimes you have to be tough or you end up on a slippery slope.thebeeches wrote: »Not my usual ID.

I'd ask them to show you a letter from their bank as proof.
If the account has been frozen due to fraud, then they should have received a letter from their bank telling them what has happened and what will happen next.Tank fly boss walk jam nitty gritty...0 -

Not your problem! They have arrears and have defaulted again. Ask for a letter from the bank, then you will know for sure. It might be the kick up the bum they need to clear the arrears etc, if not, you are best shot of them anyway.
The only time I had a tenant in arrears I gave them a S21 and explained why it was being served. They paid every last penny back to me and it was an unfortunate situation that lead them to default. But, it gave them a clear message, pay up or you're gone, and I wasn't going to wait a few months to see if they were true to their word. They were, and it was all amicable but it might not have been the case.

If it was the first time they had ever been late then it might be a tough option. If they have missed multiple payments they only have themselves to blame.
I guess from your tone you can choose to allow this, but for all they know you really need the money and they are risking wrecking your Christmas!For everything else, there's MSE :T0
