Hi Guys/Galls
Out of the blue yesterday I got a letter from an insolvency firm saying the V A T had put me in court for none payment of estmated V A T,
I had a small one man buisiness but ended it in July 2005 and deregistered from VAT and paid up all I owed, The buisiness was in a rented premisses, but since I left is now derilict, I had been paying VAT for 25 years prior to that, they knew all my details but have not contacted me in all the 3 years since I finished,at my home address, when I phoned the insolvecy office Friday afternoon they said the vat papers must of all gone to the derilct factory, I have phoned my old accountent to ask him about my deregistration but he is away till next Thursday, I know deffinetly it was cancelled, I have checked this morning on the web and all my Bankruptcy information is on the there for all the world to see, as this happened to any body else and what do you think I should do, can I claim anything back from the VAT for any bad publicity I get, from what I say is there mix up Please Help,

If you don't owe them anything and can prove, this, you can probably get the bankruptcy annuled on the basis of "ought not to have been made". Back with the link in a minute.

The petition was presented on 24th June 2008, and and half way down the same page it says dated this;3rd Oct 2008 so as it reads they have made me bankrupt with out me knowing anything about it,does this make sence to you, If they had sent me any comunication over the last 3 years I could of cleared the problem up before all these nasties started,
It also says the solicitor for the petioner and the deptor not being present or presented,0 -

Yes Im just worried what will happen while I am sorting it out hopefully when my accountant gets back to me, The VAT have told me to write to them with any info I have but I cant send them the info until I speak to my accountant, I know it will all be sorted out but I am worried about all the bad publicity my name will get, Ive been told it might be put in my local press, surely they have to listen to my side before they can do that,0 -

Advert in local press is standard. You can try and stop this, inform the OR you are applying to court for a stay of advertistment and then complete forms at court, then down to judge to decide. Need to be quick though.

You may think you are just trying to help out on this site and think nothing of it, But I can assure you ,this site as been my only help contact over this worrying week end, I have read all of the contacts you have given me and I hope to sort this problem out over the next few working days, I could not stop the Gazzette advert, but I am going to the O/R office tomorrow early to see what they can do to help, Do you think I will need an expensive solicitor to help me, or just wait to see what the VAT solicitor says tomorrow, when I ring them, I am also sending them a registered letter with all the facts on it but they wont get it untill Tuesday am

You shouldnt have to throw more money at this as if by what you have said its not your fault. I would wait and see what the VAT Solicitor says tommorow and also the OR before you make any knee jerk reactions, if they are in the wrong I am sure they will be happy to rectify it for you. (not taking sides just giving level headed advice, as I can imagine your very stressed and wound up atm with it.).
Get all the facts from there side first then you can see where things went wrong. And fix it from there.
Chin up and keep calm it will work out ok.

After speaking to the OR (as instructions for advert in local press will probably already been done and may be too late) then you need to get to the court for the stay of advertisement and an appointment before the judge. Only saw the form once but fairly straightforward (I think!) pay fee of I think approx £50 and then down to judge to grant or not. Keep the OR informed throughout.
Solicitor is up to you, but this bit should be doable on your own.0
