Do we accept Natwests' offer?

We made a claim for just over £12000.00 and they have written back offering £4927.00 with conditions attached i.e we don't try to claim any more money. What do you think - anyone.

Thanks

  • Hi

    It may be worth you checking the latest bank charges waiver, which says on page 6:

    (16) if the firm attempts to resolve a relevant charges complaint after 27 July 2007:

    (a) the firm must not seek agreement from the complainant that the resolution is in full and final settlement of the matter;

    (b) in relation to such complaints, if the outcome of the test case produces a result that is more favourable to the complainant, the firm must take all reasonable steps to pay any difference in the amount of compensation actually received by the complainant and that that the complainant would have been entitled if his claim has not been settled by the firm then; and

    (c) the firm must explain the implications of its approach and commitment;

    Before the waiver, claimants were in a strong position to dismiss such conditions, because the court route was still open. With claims on hold, the banks know they cannot be persued through the court at this time.

    In the end it's a personal decision. If you need the money now, you could state that you accept it as a partial payment for now and make it clear, this is not a full and final settlement. Refer them to Wendy's extract from the waiver, reminding them you reserve the right to be paid claim the remainder depending on the outcome of the Test Case.
