Disability Benefits?

Options
Hi, my cousin has his own business running a cafe. For two years now he has had really bad back problems, some days he says he feels like a cripple. He can only stand at the till taking and (giving) orders and his staff have to do all work. Is he entitled to any disability benefit? Is there such a benefit where you can still work and claim? or is there only certain hours you can work. He does 8-5 at the moment. He has all the relevant doctors reports and sick notes and does not claim anything at the moment.

Thanks
Old Faithful we roam the range together,
Old Faithful in any kind of weather,
When the round up days are over,
And the Boulevard’s white with clover,
For you old faithful pal of mine.
Giddy up old fella cos the moon is yellow tonight,
Giddy up old fella cos the moon is mellow and bright,
There’s a coyote crying at the moon above,
Carry me back to the one I love,
And you old faithful pal of mine.

  • He should consider if he meets the criteria for DLA
There is a self-assessment test Benefitsnow DLA self-assessment test

and another here to double check BenefitsandWork DLA self-assessment test

The criteria for the Mobility Component of DLA depends on his virtual inability to walk outdoors WITHOUT severe discomfort, while the Care Component requires details of the Care he needs to deal will his PERSONAL BODILY NEEDS. So only if he needs help dressing, toiletting, eating drinking washing himself would he get this however there is considerably more detail at the links above.
If he is new to claiming benefits he would be best advised to seek help.

  • would you use the same check if claiming an industrial injury benefit
  • While you're in the process of applying for disability, until you are approved, you can only make $940/month. If you make more than this, you are considered well enough to work and your claim will be denied.

I'd really recommend that he read up on the process and all of the intricacies of trying to be approved for disability. There is a lot of stuff out there to know about it. Do searches on Google for stuff like "disability tips", and "disability secrets". A friend of mine is a lawyer and his site is disabilityappeal.com, there's a lot of good info there too.

Good luck with it, know that it can take awhile (6 months+) to get benefits, it's good to know the lay of the land before going for it.

Just to let you know that this thread is nearly 4 years old so I doubt the OP will see your reply and also this is a British website and you appear to giving advice about the American system.
