Call National Debtline - Tel: 0808 808 4000 and have a chat with them. You can never has too much info. and it'll be instant. No waiting for an appointment
Went and told my husband who marched me off in car to CAB drop in appointment, had a lovely advisor who calmed me down and took basic information to forward on to debt advisor. I now await an appointment from them. Good, more advice and info.
I have been given a standard letter from CAB to send to the creditors, which is what I am going to do now. It'll be ignored and they'll still hassle you, i'm afraid. Is the letter offering token payments?
I have just phoned estate agent who will come out tomorrow. CCCS said that even though I have a child of 15, if I was to go bankrupt they would go for the house. Afraid so, and the council won't help as you've made yourselves intentionaly homeless:rolleyes:

Nida, if you house is in neg equity and you are able to keep up the mortgage payments, the OR will not take it! They may take the BI (or lack of) and keep an eye on it (I think for 3 years, but I may be wrong), and if it went up in value substantially in that time they may sell it to pay some of the creditors. But even if they did that they would not sell it for the first year and you would get plenty of time to find rented. The way the economy's going it's unlikely to gain a huge amount of equity, and you have the opportunity to buy the BI back from the OR anyway! Sorry, I'm not cross with you, just with CCCS who seem to be giving rubbish advice recently.
Does anyone think CCCS have recruited a lot of rookies recently? Grrrrr!
IF you decide to go BR you can, but be aware that it has long-reaching consequences for you in years to come (you will always be a BR), and your credit record will be shot to pieces. You don't have to take CCCS's advice, the judge will just ask you whether you have had advice from a debt charity and are aware of the consequences of BR. If you want to do it, despite what CCCS said, you can.
It would be a very good idea to wait and see what the CAB advise before making any decisions, though. PLEASE come back on here and let us know what they say. It'll be very interesting if they do advise BR ...

I didn't think the OR went for the house if it's in neg equity?? As they wouldn't make any profit from it. Am I wrong in thinking that? I know they'd take the BI but couldn't the OP's husband buy it back for £1 plus expenses?

Yes I smell fish as well. Have done for a few days of reading the advice being given by CCCS.
Who are they governed by? not the government I HOPE.
It seems to me that too many are saying they are not being told to go BR when I look and think WHY NOT? Others here have in almost identical positions.
I am pleased I did not ring CCCS now to be honest with you it would just have muddled me up and upset me if they had said NO you cannot, or NO not advisable.
Try not to worry OP and the Nat Debt line are open til 9pm I think today and til noon or 1pm tomorrow, give them a call. See what they have to say on your situation.
And I would like to reiterate what has been said, NO you do not deserve that type of feeling. I wonder if the state the country is in has anything to do with this type of advice? More and more people are going to be in the same position that we find ourselves in and bad information and advice is not going to help those people who do not even know about this or others sites like it where they can get help and support.
I know some people will be advised there is a better way, but to be honest I cannot see one for this lady can any of you. 26 years who wants to live that amount of time struggling.
Those who are reckless, really reckless, come on here trying to hide things, sell off assets, the wheeler dealers, well I have no time for them, but genuine people who are trying to sort things out we all have time for.

That is really nice of you Sarah to come and post to this person. I am sure you know how stressful this is for people, and I hope the OP pms you or calls back.
I also just read what you have in your signature line, and realise as others do you cannot tell anyone to go BR, take a DMP, or IVA you can only give out advice on the information you are given.

That's very kind of you, Sarah. I don't suppose you'd feel able to say anything, but has there been some kind of change of emphasis lately at CCCS? Perhaps it's just a coincidence, but it does seem strange that we've seen three or four new posters this week advised to go for DMPs/IVAs when their circumstances would ordinarily point to bankruptcy.0

Sat here crying, my husband is trying to cope with all this as well as he is understandably frustrated and angry with me. Feel the only option is to leave and not drag him down with me.
When I spoke to CCCS this morning and gave them all our income and expenditure. They wanted my husbands as well to give them a better idea of any surplus money, of which there was about £400 to pay his and mine debts, mine being about £2000 a month in commitments, so major minus already. The lady gave advice and then that was the end there is no more follow up or paperwork to come. Which is way I felt so flat, I know and accept I made this mess but I have had some of the debts for years and I have probably paid the money back but the interest is the killer. I can never understand why when they want a minimum payment of say £150 they take £140 of that in interest. That is why I am getting nowhere. I want to clear my debt but feel I am at a dead end.
Just had a recorded message ring me as I only paid a token payment as advised from first CCCS call, they are obviously wanting full amount. They will have also increase the debt now by adding £12 charges.
I am so tired and just do not know what to do. I felt yesterday that tonight I would have some hope. But I have got nowhere.
