    Hi whats happened, did it get to court or have they finally done the right thing or bottled it.

    I had a thought last night. When you were informed the date was postponed, did the court ring you to tell you this or did you ring them? I had a strange feeling last night that the radio place had rung you up pretending to be the court, you didn't turn up, they win by default etc etc.

    lol i double checked, phoning the courthouse offices myself even though it was a woman i had spoken to there previously, ya gotta be careful these days

    no jdh they still faffing me round, not bothered now, if they had any defence they would of come to court and used it, i can wait!

    I think i'm going to start a "vent" against the courts system in this country!, it was a week last thursday they allowed "incare express" to defer the hearing and i still haven't had a single thing in writing!! wth is going on?

    Not sure whether the T&C's would amount to fair, according to some posts they are unlawful so, fair is not a word i would use. And as stated many times they don't matter as they can't affect statutory rights.
    I didn't publish the full terms of the settlement as it was too dull, meaningless and amounted to nothing more than a ploy. whether it was fair or not?, i didn't think so otherwise i wouldn't have rejected it

    Well it's been a full two weeks since i got the call from the court offices and have i received one single thing through the post, not a sausage.
    I know like most government offices they are under funded/staffed but really it seems a bit of a joke when a judge can make an and nobody gets to know about it.

    Please don't take this the wrong way, but legal things can come down heavily on a single word in some instances and you don't seem to focus too greatly on your use of English (even down to not reading T&Cs).

    Could it be that you are missing something vital in all this?

    Sorry didn't mean to ignore this, got carried away by the other thread.
    My apparent casual use of English is more down to haste, poor typing and differing levels of pain killer intake at moment.
    It is funny you should mention that because it occurred to me that is exactly what is happening here, only the misunderstanding is from their perspective.
    Then I thought, no that can't be it, they really can't be that stupid, inept or dishonest to try that on, especially after taking legal advice but then again?

    Well just spoke to a nice gentleman at the courts and he gave me a summary of a letter that is supposed to be sent out to me today.
    Apparently the hearing was cancelled with with a request from the the defendants stating "it was out of proportion" that the cost of their travel from cambridge would exceed the value of the claim.
    So it appears that if you want to take money off people and not give them working goods, its "ok" as long as it costs more money to travel to the court case, you will get away with it apparently.

    Are they requesting that it is heard in a court nearer to them?

    I've only had one experience of a small claims procedure and it was years and years ago, but iirc, the defendant is completely entitled to request this?
