Problems with bling!

Evening all,
I hope I have put this in the right place, if not please fell free to move / abuse me / flame me...(well maybe not the latter 2)!)
Anyway, in 2005 I received this ring for an Xmas present: http://www.ernestjones.co.uk/webstore/detail/R/4939298/
In November 2006, (i.e. 11 months later), two stones became dislodged. I took it back to Ernest Jones with the receipt, they sent it off and said it was a manufacturing fault and gave me a gift voucher to buy something else, so I put some extra money and bought this instead:

In September this year the same thing happened, stones fell out again, two of them on the same row, one on the left, one on the right of the ring. I took it back to Ernest Jones between Xmas and New Years, and was told they'd send it off for estimate to see how much I'd have to pay.
Now a couple of things:
1. Before anyone says anything, as my signature shows, I've been in Berlin since September, (have the flight tickets to show for it!) therefore I haven't been in the UK to take it back, the stones went within a week of me getting here so so 4 months it's been sitting in a box on the shelf.
2. Both rings were worn as 'going out', i.e. not every day so no wear and tear.
3. Since the stones have fallen out on the same row, I would argue that it's a fault on the band, as they're different ends, so a bit hard to have whacked it, especially when it's had light use at best. (Was extra careful with the second one after the first one got sent back). I also think it's a bit rich to pay £170 for a piece of jewellery and have it fall apart (first one was £150).
4. What are my rights if they say I have to pay for it, as the lady in the shop suggested. I said I wasn't too happy since it happened under a year after purchase, (still have the receipt), but she wouldn't budge. I ask this since they refunded the other one, I assume they should do the same this time?
Any help / opinions anyone can offer would be extremely appreciated...at present it's in the sop and they're going to phone my boyfriend when it comes back, (I go back at the end of the month so hopefully can resolve this then).

no answers- just sympathy
and to say something similar happened to me. they repaired my ring twice for free but then said it was only suitable as a 'dress' ring and that 'old style' settings are not as robust as modern ones.
(no dishwashing i guess they meant) and would not repair it if it needed it again. it has been in my drawer every since.

I'm hoping it might not come to that, and I didn't wash up with mine either! It's a joke really, I have two white gold and diamond rings from there and also a white gold and diamond pendant (sorry not trying to show off, just the fact that I am not a bad customer of the chain and am not completely thick when it comes to looking after jewellery!)
I've been sneaking through the consumer rights thread in the hope of finding some ammunition should it come to writing a letter / trying to claim the cost of the repair back....I like my coffee black, just like my metal!

Update, how spooky....have just had a call from Ernest Jones...
They want £149 to fix a ring that cost £170.

Irrelevent of where you were you were outside the 1 year guarantee. They could easily argue that you should have called or written to notify of the fault therefore giving a date of when it happened instead of just your word.
As for your rights again its your word against theres and as you have no proof of the date it happened and it could have happened after the year this would be hard to prove.
It is unfortunate about the company as maybe they should have been a bit more understanding especially after your previous experience but it does look like they sort of have you with this one...0 -
True, I appreciate that I should have called or something, silly what living abroad will do!
To be honest, I don't mind having to pay to get it fixed if I have to, I just think the price they have quoted is madness!
But anyway, I am getting my mum to go down there at the weekend (she works for a firm of solicitors and is very good when it comes to getting a point across), so I'll keep you updated!...I like my coffee black, just like my metal!

Take it for a second opinion ... It does seem a bit pricey... Or just go in and cause a scene when its busy and bring up the fact you only got that ring because of the fault with the other..0

My dh bought me a white gold necklace from EJ 2 years ago, the first chain didn't last 3 weeks so got it replaced and 6 weeks later it broke again. we were told that because he'd bought insurance we were entitled to a replacement chain - I argued that because we had been given 2 faulty chains we should be entitled to our money back. I know for a fact that some jewellers in my city send all repairs and adjustments to little backstreet shops within a couple of streets away and charge the earth for the service, pretending that's it's been sent away, out of town. Do yourself a favour and take the ring to a little jewellery workshop where all they do is repair watches, chains etc and I bet you're pleasantly surprised. Look up the Yellow Pages and you'll be amazed at how many little shops there are that don't really advertise. I've saved tonnes over the years and would never get jewellery serviced or repaired at a High Street Jewellers. Hope this cheers you up a bit. Good Luck. :0)0

Thanks for the advice, that is what my dad is doing with the ring this weekend, im and mum are going into EJ to have a moan at them and see if we can do a bargin with them, if not then it's going to the local jeweller who prices things fairly! (We get quite a few things done there, last time mum had a white gold chain that snapped and it was re-soldered for about a tenner).
That's what makes me angry about all of this, I don't think I should have to pay, but if I do, I want to be charged a fair price for it! Bloody big companies, but hey it's their loss as neither myself or my family will ever buy anything in there again after this, (and that is a loss, my mum gets through quite a lot of bling!)
