Friend Damaged Trailer-wont sort it out

Hi, i'm after some advice concerning a so called friend of ours and our trailer that he was using.
Both ourselves and the 'friend' in question run our own airport transfer business's. We pruchased a trailer to be used for this business and for when we went camping. The 'friend' somtimes borrowed our trailer for the odd job that he had when he couldn't fit all the luggage into his vehicle. This particular time he borrowed it, it was damaged while in his possession. Basically an articlated truck run into him from behind. The galvanised 'A' frame was completely bent and the place where we bought it from stated it was a write off and the trailer saved the 'friends' vehicle from being damaged itself. At the time the 'friend' got the proper info from the truck driver and company and told us on many occasions that his insurance company was sorting it out. He refused to give us a copy of the information and kept saying 'it was on his vehicle at the time, he will sort it out' We have badgered him so many times for this information and to try and get it all sorted that he no longer talks to us. We\ve since found out that because the trailer had our number plate on it, his insurance company have refused to pursue the claim for our trailer and we should do it but we cant because we havce no info. the friend now says he hasn't got the info now cuz his dippy missus has thrown it away. He is refusing to ring his insurance to get the ifo they've got stored from when he reported it to him
To be honest, the reason i think he woont give us any info is because he never reported it. apart from pursuing this through the small claims court i realy dont know what to do. He is so vindictive, he spreads rumours around about me and my family as it is

If the trailer is registered under a business name then I do not think you can go down the small claims court procedure. i think it is for individuals only but not 100% sure.
What was the value of the trailer? Are we talking £100 or £1000's? Has any other equipment been loaned either way? If you have something of his, indicate you are taking it in settlement of his debt and see how he responds.
Surely when the crash occured he would have had his own reg plate on the trailer (so as to be road legal) in which case his insurance companies argument seems like a cop out, possibly invented by him.

the trailer was for personal use for us...not registered under a business name and it was worth 600.00
no other equipment has been loaned between either party it was just our trailer loaned to him on a few occassions.
unfortunatley he was too tight walleted to go out and purchase a reg plate to match his vehicle so yes he was driving illegally using our reg plate. maybe thats why the insurance company wont do anythig thats if he did notify them. he's that much of an @rse he wouldn't report it and hope we'd accept what he's done and wave ta-ta to our trailer0 -
the wierd thing is that if some1 hits the back of you, then it is seen 99.9% of the time (unless exceptional circumstances) that it was the driver behind who casused the accident. as they factually did not leave the correct stopping distance, and were too close.
so the strange thing here is that surely the insurance should have covered it... i mean it would have clearly been the driver behind's fault. and as another poster said he would have needed his OWN REG PLATE on the trailer.
hmmmm sounds like he hasnt ever reported it tbh. probably doesnt want to make a claim and up his premiums. what a 'friend'0 -

I wonder if your friend has settled with the guy who caused the accident and pocketed the money??????? hence his reluctance to give you any information.Just about to give up!0

well to be honest this wouldn't surprise me in the sloghtest, he's very vindictive and would screw his own mother over.
i sent him a letter recorded delivery on the 1st october requesting information on the incident and giving him 14 days to reply with the info.
i'll give him another week due to postal strikes etc but to be honest i aint expecting to hear from him and will have to go throughthe small claims court to claim the money back off him. its just cost me another 680 quid to replace the trailer, i dont see why we should pay out cuz of some other fat prat who is with holding information on the subject0
