In that case I would definitely complain, if they are being such prats about it.

Can anyone please tell me - does this apply to my case?

HSBC are refusing to give it back unless I agree to a higher repayment with them (ie default on my arangement with cccs). I'm not falling for that one, so I will go to CAB on Monday and see if they can get them to give it back (payment shows as from DWP so as far as HSBC are concerned it could be income support). Failing that it will be a letter to them and then following up with the banking obudsman 8 weeks later.
Once this is resolved I am going to go after them for every single last penny of the rediculous charges they have applied to my account.
Thank you to everyone who has taken time out to reply to me, again the support from this website has been a huge support.

You are welcome but it is annoying that you have been so let down, i wish the outcome was different but well done to your attitude much better than lying down and letting them treat you that way!

Oh Kaz sorry to hear about this. Same thing happened to a friend of mine in January this year and the outcome wasn't good I am afraid.

Income support said 'The payment has still been made to you so we can not pay out in this case'

Banks/CAB said 'Unfortunately because it is not a means tested benefit it does not come under Social Security Administration Act 1992 therefore there is nothing we can do'

Now she has her partner pay the CSA direct and they pay that to Income Support, so it doesn't happen again. I am unsure how this was done. Basically all of her CSA money goes to them and they add the £10 I think it is onto her income support. That way if the bank swallowed it up again she would be able to get it back.
One day I might be more organised...........

My advice on the maintanence would be to see you local MP asap. This happened to my sil and she did exactly that it took only a short while but it got sorted in the end. Its disgusting. Its about time the government used their alleged intellect to work out far better systemsd that can be understood by anyone without need a masters in maths! Then they should employ people insted of halfwit monkeys for their customer service department. I wonder if they actually put in place a system 'if you do your job, you get paid' would the work actually be done! Its seems to me that when you ring these people they go yes sorted then a month later you find out that they sat tapping their fingers on the desk!!!!!
You can touch the dust but please don't write in it !

Would you like to speak to the man in charge, or the woman who knows whats happening?

Thank you lil_me and chunky79. Fortunately I'm feeling ok about it all and managing to enjoy my weekend despite the mess up, but your post made me giggle chunky - I think you are quite right and I wish they would bring in such measures! No doubt there are a few dedicated workers, but I never seem to get through to them (except once I found a good one - and then they moved him to another department, lol)
Thank you again both - fingers crossed CAB might be able to talk some sense into the bank, lol.

    Hi, again, Kaz!

I'm back at work, so I've taken a look at the CPAG "Child Support Handbook". You can request a *special payment* from CSA , as you have "suffered an actual financial loss" due to "CSA error".

If you get no joy there, you can make a complaint to the Independent Case Examiner. Forms to do this are available on the website.

The DWP Guide to Financial Redress for Maladministration covers the CSA and might be worth a look.

HTH, PM me if you need more info.

This is disgusting I think in your shoes I would complain to everyone I could. That means MP, head of dept, head of CSA as well as following the route that Penny suggested.

    Good luck
