Time off work due to school closure....can they force me to take unpaid leave or hols

I apolgise in advance if this is relevant to another thread but the only one I could find was a year old and employment law/advice changes frequently......so Im hoping Im doing the right thing and not offending anyone.

My little one went back to school on Tuesday - which is when we got the worst of our snow. School called and said the school was being closed and I had to come and collect him, which I did. I took work home with me and our back office system is web-based so have been able to do bits and pieces from home as the school has been closed both Wednesday and Today.

My work are now telling me that if I dont make it to work tomorrow due to the fact my little one isnt at school I will be forced to take it as holiday or as unpaid leave.

Can they do that?

There have been plenty of threads on here about this. Short answer, yes they can, it is not their fault that you have a child and can't go to work.

Was watching this on the TV and yes they can, unless you had some agreement in your contract.

Sorry it is not the answer you wanted.

  • As the others have said above, yes they can. It's a slightly different situation if it's because the weather's preventing YOU getting to work, rather than you staying home because your child is at home - then they can make you take annual leave/holiday, but possibly not stop your pay for the day. Sorry.

Thanks for the replies - my car is stuck in my street but I could walk to work in about an hour so I could go to work if it wasnt for my little one being off school.

    Thanks anyway.

I was lead to believe that it doesn't matter the reason why you can not get to work, they can still treat the day as unpaid leave if you do not make it in.

Depending on the reason you could be disciplined for not getting into work.

The above amounts to fraud. What price honesty and personal reputation? This site is about money saving - not theft!

Jo - I have responded on the other thread you have posted on.

I'm in the same situation, I'm going to request taking it as 'carers leave' although I'm not too hopeful but even one day paid will be a help and I will make the rest of the hours up when I can.
If you're going to stalk me, while you're at it can you cut the grass, feed the dog & make sure I've got bread & milk in :D
