Reset my credit score

Basically, fairly simple in my eyes. My "poor" credit score is a result of me refusing to pay back bank charges, therfore defaulting on two accounts. Its not a fortune the total is roughly £400. However, like I said my credit score is a direct result of unfair bank charges. I believe that if the supreme court decides bank charges are unfair on Wednesday, (although we all know the banks will try to delay proceedings further) that my credit score should also reflect this and be improved or reset. Its just logic in my eyes. Does any one else agree. Who would I have to go through to get my credit score renewed?? Be very interested to hear your thoughts as this may well be the case with lots of members.

Cheers, Dave.

Didn’t you ask the same thing back in March?

Have you moved on anywhere since then?

My personal view is that, at the time that that you incurred the bank charges they was no legal ruling as to whether they were fair or not, yet you chose to predict future events (that even today have not yet occurred) and let the charges default on your accounts.

The court may decide that bank charges are unfair (as you say yourself "if the supreme court decides bank charges are unfair on Wednesday") and it may be likely that the outcome will agree with you, but until the ruling occurs you can’t use your opinion of future events (no matter how likely) as a reason to default.

The ruling from the court may allow you to reclaim the charges that are deemed unfair, however I would have thought that the impact that the subsequent default had on your credit score was as a result of your actions (or inactions), not the bank’s.

This is just my opinion and more informed people may be able to give more solid advice, but I’m afraid I don’t agree your credit score should be reset as a result of a choice you made. Sorry.

  • Hi Dave

    2 Points:
1st Up to and including this very moment the charges are illegal, the banks have to win their appeal against this on Wednesday to change that.

2nd All banks have signed the Banking code (clause 13.6) and its successor the lending code(section 3 clause 35), they are both online. These clauses are in respect of credit reference agencies. In short both state that a bank will not report an account as being in default if you are in dispute with them over it. The main caveat is the whole balance must be in dispute.

The bottom line is that this is the banks in effect kicking the cat, they know they`re unlikely to win so they do this knowing it will cause substantial vexation to anyone on the receiving end.

    Hope this helps good luck
