They could claim tax on the 20p a mile whether they were employed or not. It has to be your own bike though, if you were to use a bike provided by your employer then you can't.
It'd be worth 4p a mile in tax relief if they used their own bike, I'm not sure really how much this is worth but as bicycle journeys are always going to be a lot shorter then the amount reclaimable must be relatively small.
