    This really is a matter for the regulator. It does interfere with the consumers right to choose. And I suspect the agent is getting a kickback. If this is the case, the regulator should be dealing with the kickback issue.

    If the supplier is getting a kickback then yes the regulator could get involved but if the letting agent / landlord wants all their eggs in one basket so to speak, presents this in a tenancy agreement for to be signed, then the regulator can't do anything. They have no authority over the agents / landlords. If you want the property you agree to their terms. If the agreement said no virgin tv / SKY to be installed I don't think this issue would come up and this would also be restricting the tenants rights to the best deal they can get on tv / internet / phone.

    I think this came up on the 'House Buying, Selling and Renting' board as an unfair clause and therefore unenforceable. Run a search and I bet you'll find the answer from professional landlords.

  • I've had a look at an OFT Unfair Terms documtent, table 4.2 at http://www.oft.gov.uk/shared_oft/reports/unfair_contract_terms/oft356.pdf

    "Obligation: Against changing the phone or utility supplier."

    "OFT view: The tenant should have the choice of supplier although he may be required to keep the landlord informed of any change and to return the account to the original supplier at the end of the tenancy."

    Doesn't mention anything about charging though.

  • Totally totally totally an unfair clause. Not only does it fall firmly under the OFT's guidance on unfair terms, I believe this has been tested in court (the true test) and found unfair. If I had a bit more time I'd dig for an exact reference, maybe I will return to this later.

    You have a complete right to choose utility supplier. It's your utility, nothing to do with a third party.

    If they do try to bill you, tell them you will see them in court. If the try to deduct from deposit, go to arbitration and you will win.

    Are you sure you could arrange to change back and have it happen in time so that the agent didn't know?

    Actually. if the agent is getting a kickback, which is what I suspect, then they would know straight away.
