    On behalf of some of the other regulars, I apologise if some of the replies were a bit on the sarcastic side. In their defence, I'll say that since Martin's email on Wednesday, it seems that every 5 minutes when we come to this page, there's another new poster asking essentially the same question "Is my private parking ticket enforceable?".

    Whether or not you used the venue is unimportant. In order to sue in court, the PPC would have to demonstrate that they suffered an actual loss - not their so-called "Civil Penalty Charge", as penalties cannot be levied under English contract law. There are no charges for using the car park, so the only way they could suffer a loss is if all the spaces were full, and potential customers were being turned away. Even then, the amount of loss would be difficult, if not impossible, to establish to the satisfaction of a court.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

  • Okay thanks, I was pretty certain the answer would be dont pay it, I just wanted to make sure. I have been a regular visitor of the forums for a long time now and I do receive the newsletter, that's when I saw the coincidence of the warning about private parking companies just as we had a ticket a few days ago. I understand that a lot of new posters are asking the same question in different flavours, so any other time I wouldn't get the same response. Thanks Orford for answering my original post, I was very grateful but prefer to take advice from more than one answer, surely you can understand.

    Cheers anyway guys, we won't be paying it! :)
