CapQuest Debt Recovery

I am quite new here, so Hello everyone!
I have had dealings today with CapQuest.
The story goes...
I owe a debt of about £1500 on a credit card with Sainsburys Bank which I fully admit is mine. I got a letter today from CapQuest asking for £70 a month by DD. I was more than happy to pay this and called them to make an initial payment of £70. I got through to one of their advisors. She said she would not accept the £70 a month and practically demanded £150.
I told her I was unable to pay this and was happy to pay the £70 which the letter asked for. She said I must send in details of all my financial ins and outs.
I really don't want to tell these people about my finances as I think this is personal to me.
I wanna know if I have to send details in, or can I refuse? Can I pay the £70 a month which what was asked for?

You have to send the details in. You have no choice. Not even the Consumer Credit Counselling Service will let you make an agreement without showing a Statement of Affairs.
At the end of the day, you got yourself in this mess and you're going to have to accept that you have little control over what information you can and can't give if you want to set up a payment plan with ANY such company.
If you don't want to give them the information then that's up to you but there's not a single debt management company or charity who'll help you.0 -

You have one of two options, pay cap quest WHAT YOU CAN AFFORD or better still refuse to deal with them and pay what ever you can afford to the original creditor, Cap quest are well renowned for bully boy tactics, even if you did agree to £150 today they will be back on the phone within the week wanting £250 out of you.
remember, although there is no question that the debt is of your own making, you are in control of when and how to pay it back, do not overstretch yourself as this is just a road to further financial and emotional problems.:rolleyes: It’s hard enough remembering my opinions - without remembering my reasons for them :rolleyes:0 -

sometime I think you read postings too quickly and don't understand them Capquest is a Debt Collection Agency and not a Debt Management Company the poster is under no obligation to send them an I&E, the only time he should do that is if they take him to court then he should supply the judge with an I&E. Really I am not having a go at you but I have noticed you jump in like this before and give completly wrong advice0 -

Your not in the minority there!, CapQuest / DCA’s in general make a habit of pressurising people to paying amounts which they really cant afford to, and then act all aggressive and surprised when you miss payments that you had no real chance of making in the first place.Grovers wrote:Thank you for the reply guys. I know it sounds like aggressive gorilla tactics in refusing to comply to what they request ( i.e demand) but in real terms you are only making your situation worse if you agree to something which is unrealistic to your present financial circumstances.
With regards to your original post if you can really afford £70 then great you can clear the debt in a relative short time, if not then pay what you can afford.
It sounds hash but if the creditor / debt collector were to take you to court ( exceptionally unlikely if you are making payments) then a judge will only ever award them what you can REALISTICLY afford, which in true terms is probably a lot less than the £70 you have already offered, CapQuest are more than aware of this fact which is why they try their best to extract as much as possible from you without having to go to court Ect.:rolleyes: It’s hard enough remembering my opinions - without remembering my reasons for them :rolleyes:0 -

No No No Do Not Send Statement Of Means State You Wish To Pay £70.00 Thats It If They Refuse Say You Wish To Go To Court Where You Will Gladly Show Your Finances ,this Company Will Leave You To Starve Pay Only What You Can Afford Ignore The Clapptap They Spu Out ItS All Gas Good Luck0

What a load of tosh some people write on here.
Of course you have to justify the payment you offer - as Conor mentioned you either do it now and amicably with the dca or lender or later with CCCS/CAB/Payplan or even later at court !
Your choice - remember that you want them to accept a lower payment, why wouldn't you work with them to achieve that ? Some of these 'armchair experts' are out to cause as much disruption as possible for dca's - this does you no service what so ever.0 -

At the very least you owe it to yourself to do a SOA so you are absolutely clear to yourself what you can afford
