Please Help Me Out!

Hey Everyone I Know This Is Most Likley In The Wrong Part But I Cannot Find Where Too Put It!
The Thing Is I Am Looking How Too Complain To K-swiss Trainers. I Bought Trainers For My Partner And After 1 Week They Have Fell Apart Usually I Never Complain, But I Feel Really Annoyed, Mostly Because It Has Taken Me Ages Too Save For Them

12 Months Ago My Partner Was Paralised In A Accident, I Gave Birth Too Twin Boys 6 Mnths Ago And Now Have 3 Kids Under 3, And Too Top It Off 3 Months A Go I Was Diagnosed With Cancer, So Things Are Crap Too Say The Least.

So Money Is Tight, And I Am So Annoyed As Theye Are Meant To Be A Good Brand, Like I Said He Has Worn Them 3 Times During Physio, He Has Not Done It Himself.

So I Want Too Know How Do I Go About Making A Complint I Cant Seem Too Find A Address Or Anything, I Do Not Think They Want People To Be Able To Complain

Does Anyone Please Know Or Have Any Ideas I Would Be So Grateful

    Just take them back to the shop and explain to them what you have put here, better still ring them first.

    Your contract is with the shop you bought them from, so you need to take them back to the shop. Do you have the receipt to prove they are only 1 week old?

    KSwiss aren't necessarily good quality, as you are mostly paying for the brand name! Given how much they spend on advertising, I'd be surprised if they had any money left over to spend on quality!

    It's when caps lock is left on, the website does it's best to correct it.
    (OP maybe you don't know the "Capitals = Shouting etiquette". Good luck with your complaint; shouldn't be too difficult I think.)

    I bought a pair of shoes from Barratts once that fell to pieces within a fortnight. A friend of mine who was studying law at the time (now qualified!) took them off me and marched back to the shop quoting the Sale of Goods Act and arguing that shoes were meant to be worn for longer than two weeks and as such, they weren't fit for purpose and I was entitled to a replacement (I didn't want my money back - just a pair of shoes to play with). Eventually the manager gave in and got out a replacement pair.

    I was very happy, but the same happened to the replacement shoes... After they broke too, I swore never to buy shoes from Barratts again! ;)

    If you have the receipt to prove the age of the trainers and use the phrases "Sale of Goods Act" and "not fit for purpose", I reckon you should get your money back. Good luck! :D

    As others have stated your contract is with the shop you purchased them from and not Kswiss. Providing you have proof of purchase there shouldnt be an issue. Dont be fobbed off by the shop if they tell you to complain to Kswiss, your contract is with the seller.

    The two key points being:

    • Wherever goods are bought they must "conform to contract". This means they must be as described, fit for purpose and of satisfactory quality (i.e. not inherently faulty at the time of sale).
    • Goods are of satisfactory quality if they reach the standard that a reasonable person would regard as satisfactory, taking into account the price and any description.

    I have used a printout of my account to convince Argos what date I bought something so I think you'd be ok as long as it shows the retailer and price.
