Terms & Conditions

1. ELIGIBILITY
This competition is open to any person resident in the UK who is 18 years of age or older at the time of entry. Employees of Microsoft or its affiliates, subsidiaries, advertising or promotion agencies are not eligible, nor are members of these employees' families (defined as parents, children, siblings, spouse and life partners).

2. TO ENTER
Entry into this competition may only be made via the xboxmygig.co.uk website. To enter you must submit your ultimate gig line-up poster, including your ultimate gig's name and the three artists you would choose to perform at your ultimate gig along with a completed entry form. You may submit more than one entry but each gig name must be different and you must complete a separate entry form for each one that you submit.

Incomplete, damaged, defaced or illegible entries may be deemed invalid at the sole discretion of Microsoft. Proof of submission is not proof of entry and no responsibility is accepted for entries that are lost, delayed or damaged. Microsoft reserves the right to refuse entry to the competition and remove any entry from the website which in its sole opinion it considers offensive. Entry constitutes full and unconditional acceptance of these Terms and Conditions. Microsoft reserves the right to disqualify anyone in breach of these Terms and Conditions.

3. TIMING
This competition runs from 12.01:00 a.m. GMT 06/08/08. The closing date of this competition is 11.59:59 p.m. 15/09/08. Completed entries must reach Microsoft no later than the closing date.

4. USE OF DATA
Personal data which you provide when you enter this competition may be used for future Microsoft marketing activity.

5. SELECTION OF WINNERS
Entries will be displayed on the website and members of the public will be able to vote for their favourite gig name and line-up. Members of the public may vote for more than one entry but may not vote for the same entry more than once. Votes will be monitored for use of unfair or automated voting practices and Microsoft reserves the right to take any action it deems appropriate in the event such practices are discovered, including cancelling the competition. The top 100 entries with the highest number of votes as at the closing date will go before a panel of judges. If there is a tie for the 100th place, all tied entries will go before the panel of judges.

The winner will be determined by a panel of 3 judges within 7 days of the closing date. The panel of judges will include at least one independent member from the music industry. The panel of judges will pick the winner based on the originality, creativity and appeal of their gig name. The panel of judges' decision is final and no correspondence will be entered into.

The winner will be notified by telephone within 14 days of the closing date. If the winner cannot be contacted within this time, an alternative winner may be selected.

The winner consents to their participation in further publicity or advertising.

6. PRIZE
The winner will receive the opportunity to help Microsoft organise the ultimate party, which Microsoft has a total budget of £50,000 for. The maximum budget will not be exceeded and may only be used in respect of the actual staging of the party. The ultimate party will take place on 8th October 2008 at Koko, Camden High Street, London or a venue of equal standing should this venue become unavailable. A maximum of £22,500 of the £50,000 budget will be made available for entertainment costs. The winner and their guests must be available to attend the venue on the relevant date. The winner will have the opportunity to invite a maximum of 200 guests to the party. Microsoft reserves the right to invite further guests at its discretion.

The winner's preferred choice entertainment and all other aspects of the party are subject to availability and Microsoft's final approval. The prize is as stated and is non transferable. No cash or other alternatives are available. Microsoft reserves the right to substitute a prize of equal or greater value. The winner agrees to be bound by any third party terms and conditions applicable to the staging of the party including but not limited to those relating to the use of the venue.

Use of a false name (name by which the entrant is not usually known) or address, will disqualify them from receiving any prize. Microsoft reserves the right to oblige any potential winner to provide documentary proof of their identity, age and address as directed by Microsoft before such person may claim their prize. Microsoft may require any person to present themselves in person supported by such documentation for identification purposes (we will reimburse all reasonable travel costs incurred) prior to releasing the prize.

7. WINNERS LIST
The winner consents to their surname being made publicly available. The winner's surname will be available for a period of three weeks after the closing date by written correspondence including a stamped address envelope to Xbox Presents My Gig, neon communications, 12 Goslett Yard, London WC2H 0EQ.

OTHER: Microsoft cannot guarantee the performance of any third party and shall not be liable for any act or default by a third party. Participants in this promotion agree that Microsoft will have no liability whatsoever for any injuries, losses, costs, damage or disappointment of any kind resulting in whole or in part, directly or indirectly from acceptance, misuse or use of a prize, or from participation in this promotion. Nothing in this clause shall limit Microsoft's liability in respect of death or personal injury arising out of its own negligence or arising out of fraud. No correspondence will be entered into regarding either this competition or these Terms and Conditions. In the unlikely event of a dispute, Microsoft's decision shall be final. Microsoft reserves the right to amend, modify, cancel or withdraw this competition at any time without notice. These terms and conditions are governed by the laws of England and Wales.
