Which O2 Surprises could you receive?
10. The type of Surprises that will be made available to you will differ depending on the amount you have topped up.
11. There are two categories: the O2 "silver" category of Surprises (for top ups that are between £10-£14.99), or the O2 "gold" category of Surprises for top ups that are £15 or above.

Prizes: Monthly Grand Prize Draw or Instant Win
12. You will also be automatically entered into the monthly grand prize draw when you play O2 Surprises. The number of entries you will have for the monthly prize draw will differ depending on the amount you have topped up. O2 “silver” category entries for top ups between £10-£14.99 in a single transaction within a given calendar month during the Promotional Period will give you 1 entry for every £1 spent, and O2 “gold” category entries for tops ups of £15 or above in a single transaction within a given calendar month during the Promotional Period will give you 10 entries per £1 spent
13. The winner of the grand monthly prize draw will be selected at random from all qualifying entries received during each calendar month in the Promotional Period. The draw will take place as soon as possible after the end of each calendar month during the Promotional Period. The grand prize for each calendar month during the Promotional Period will be advertised on the O2 Surprises website. The November grand prize shall be a Mini Cooper S car.
14. The winner/s will be selected and prizes allocated at random from all eligible entries received by an independent third party, Buongiorno UK Limited, 20 Orange Street, London, WC2H 7NN. The winner/s will be notified and prizes delivered within six weeks following the date of the prize being drawn.
15. In the event that you have won a prize and in order to enable O2 to deliver that prize, you will be required to leave your full name and address on the allocated section of the website for prize delivery. Your details will be treated in accordance with our Privacy Policy. A signature may be required upon delivery of a prize. 18. Unless otherwise stated, where the prize requires attendance at a specific venue, the winner and any permitted companions will be solely responsible for travel to and from the venue. In such cases O2 will not be liable for any change of date or venue or cancellation of the event. Any additional terms of entry specified by the venue will also apply. The winner/s may be contacted and asked to participate in publicity connected with this promotion.

The prize description is illustrative and not definitive, and to the fullest extent permitted by law (and not otherwise) O2 assumes no responsibility and is not liable for (a) the accuracy or otherwise of the prize description or illustration, (b) any representation, warranty, condition or guarantee in respect of the prize (other than those warranties or conditions implied by statute and which cannot be excluded), (c) the loss, late receipt, damage of or non-availability of the prize, and/or (d) any fees, charges or other costs which winners may be required to pay any time in connection with the prize.

21. If a winner is unable to be contacted after a reasonable period or any prize is declined, a supplementary winner may be drawn at O2's discretion.

Gifts
22. You could receive a gift each time you play O2 Surprises.
23. Where possible, O2 will use its reasonable endeavours to provide you with gifts that are most suitable and relevant for your tariff. In such instances, your gift will be randomly selected from a range of the most suitable gifts. For example, if you are on an Unlimited Text tariff, O2 will try to ensure that you do not receive a 'text' associated gift.

25. Gifts are for use in the UK only.
26. Peak is defined as 7.30am to 7.30pm Monday to Friday. Off-peak and Weekend is at all other times.
27. If a gift has been added to your account you will receive a text confirming when your gift has started and when it will expire. This should happen within 4 hours of being notified of which gift you will receive.
28. You will not be informed in the event that your gift is in low balance or has expired. However, you can receive the remaining balance of your gift by sending a free text with the keyword BALANCE to 20202 or calling free of charge from your O2 handset on 4444.
29. Where you have a free monthly allowance, Treat allowance or Bolt On allowance that includes the same type of allowance as your gift, the gift allowance will be used first..
30. Compatible handsets may be required in order to benefit from certain gifts.

General terms
31. O2 will not be responsible for any inability of a customer/prize winner to take up a prize/gift. This shall include any age restrictions that could prevent a customer from receiving a prize.
32. O2 will not provide any substitute or alternative prizes or gifts of similar value should the specified prize or gift become unavailable for reasons beyond its control. Cash or credit alternatives will not be offered.
33. Prizes or gifts are not transferable or exchangeable. In the event of fraud, abuse, and/or an error affecting the proper operation of the promotion, including the allocation of more prizes than are available, O2 reserves the right to end or suspend the promotion; amend these terms & conditions; declare void the notification of winners; and/or to allocate available prizes by conducting a simple draw from all wrongly allocated winners.
34. 36. If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
