Going to Court on the 11/080 advice needed

hi everyone.

i dont know if any one remebers a thread i posted a few weeks ago about the LL going a runner and the mortgage councilor coming to the house.
anyway since then i got a letter from some solicitors addressed to the occupiers stating that the LL is due in court on the 11/08. i called them and told them i am the tenant and they said that i can attend the hearing.

can anyone please advise me on what i should say. i dont know how quickly they can take the house. or how long i will have to get out.

the LL is obviously not going cause they still cant find her and still sending her all the letters to our address.

help appreciated,

  • Go to the court taking all your paperwork.

    Be the first in the queue for when the court doors open.

    Ask to speak to the duty solicitor.

    The judge and solicitor will be on your side.

    More info? Whose solicitors and what is the legal action? Frankly, I doubt you get to speak and I don't think they have your interests at heart.
    After the uprising of the 17th June The Secretary of the Writers Union
    Had leaflets distributed in the Stalinallee Stating that the people
    Had forfeited the confidence of the government And could win it back only
    By redoubled efforts. Would it not be easier In that case for the government
    To dissolve the people
    And elect another?

    Defo. enquire about what the court proceedings are about. It's likely the Crock's people getting legal possession from mortgage defaulters, in which case there may be 10s all going through as a legal formality and the proceedings will be over in 5 minutes.

    Once the Crock has reposed, then you could spin out any eviction process for maybe 6 months, depending on what papers you've already been served with and their legality.

    It is in court, so there is legal action. Who is asking the court to do what?

    Northern Rocks solicitors are sending LL to court to gain possesion of the house becuase she has not been paying the mortgage.

    lets face it, you hvnt done anything wrong so dont be nervous

    they will repossess but it could be months if you get the duty solicitor
    to explain that yur piggy in the middles.

    in the meantime, look for somewhere else to live and yu can put it all behind you and get on with the rest of your life

    I doubt then you get to speak. Others may advise better. It is just that the solicitor cannot really discourage you from attending something which is a matter of public record which affects you. You might just consider getting the judge to put a stipulation in the order that you have some interim security, although how you get to ask for that, I don't know.

    i am sorry you have been given totally incorrect information here - your legal contract is with the LL - not with Northern Rock - your LL has defaulted on her legal contract to pay the mortgage -THAT contract takes precedence in law. The judge cannot allow you to continue to stay there for months - and no this is not fair, but, it is the law.

    i would seriously start to look for somewhere to live very quickly indeed.

    i would go to the court as others suggest, taking your tenancy agreement - but be prepared to be given 28 days to leave
  • I stand to be corrected, but my thinking was that the judge could give Northern Wreck a suspended possession order on the property.
    This would give them more time to find the mortgagor who has done a runner.
