Sales of goods act after retailer gone into administration

A quick query.

We bought a Washer/Drier which after two years of constant breakdowns (more and more lately), we're pushing for a replacement.

We bought it online and it was delivered direct from the manufacturer, but they (rightly I believe) say a replacement must be made by the retailer as my contract is with them under the Sales of Goods Act.

The retailer initially said my contract was with the manufacturer (due to it being two years old and delivered by the manufacturer), but on challenge informed me that they are a new company after the initial one went into administration (same owners :rolleyes2) now so that's that from them.

Any ideas please, or is that really just it and I look at getting a new machine from a different retailer and manufacturer? :mad:

    I would write a nice polite letter to the manufacture and see if they will fix it for free or at a reduced cost
  • Was it purchased with a credit card? If so the card company can be held liable

    The engineer (we bought a year's extended warranty :rolleyes2) should have come last Tuesday but was sick so instead was coming this Monday. (Shame really as it would have been his forth visit in four weeks).

    Today they left a message to say that he was still sick so we could have the next available appointment of 13 June, 23 days after I booked him. (Another aside, but when I booked the third appointment I joked with them that I should book another appointment for the following week after the third, how ironic that if I had then maybe it would have been fixed weeks ago!)

    I called them back today to vent a little and see where I could get, the person I spoke to could only try to find an earlier appointment and ring me back (still hasn't :wall:) however she said that after three months with us, a naff machine really was their problem to resolve, 'all the retailer did was make the sale'.

    Interesting and even if it is not legally correct, I am happy to ring them back on Monday to see if I can use that to get them to replace it with a new one.

    The trouble with only getting repairs is that it costs £70 per annum (which grates seeing as how it just shouldn't break) and we have to wait at least a week (or 23 days) for the engineer to come out to (not) fix it.

    It's clunking away now like the bearings are going, on Monday kept tripping the electrics until it just complained that it was overheating (translating the F-13 display message on the internet) and the drier doesn't work. I can see the engineer coming and leaving a couple of those faults. Then as technically the extended warranty has run out we'll have the battle of them demanding another £70 to come again :( (they can go fish)! :mad:

    As for using the credit card, we did, but it's been two years so could I still go to them? :think:

    Well Hotpoint have washed their hands of it well and proper, denying they have any responsibility, that is with the retailer.

    So, all we are left with is a clunking, potentially dangerous Hotpoint washer / not drier at the moment until the engineer comes back off sick.

    I'd always thought that Hotpoint was good but it is clear from asking around that they aren't, apparently Bosch is a more reliable brand. ;)

    Won't by it from QED-UK though... ;)

    As I said to the woman from Hotpoint, it may be legally correct but doesn't Hotpoint feel it has a moral obligation to produce products that work.

    I didn't view her response positively. :(
