DLA Mobility Component Abroad

Does anyone know the reasons why DLA Mobility Component is not being paid to anyone who retires to a an EU member state country, and is this being legally challenged anywhere?

It isn't paid because in Oct 07 the European Court decided that the mobility component wasn't "exportable", while the care component of DLA and AA was.

The DWP is currently studying the decision and has not yet made any comment on how the issue will be dealt with in future.

However, the rules are different if you are just going abroad for a holiday:

HRM allowance is only payable abroad if you are a member of the armed forces or dependant stationed overseas, you are still classed as habitually resident in the uk so therefore entitled to keep all benefits you get in uk aswell as your car, motobility just export it for you.0
