rental deposit not returned

hi, can anyone advise me. I have a landlord with an outstanding rental deposit who seems to be playing silly games. originally they said the carpets needed a clean so they would return deposit when they knew how much it would be. this went on for 3 weeks. I told them i needed it back urgently and could they send the bulk of deposit and return balance when they knew the cost of carpet cleaning. She promised she would and even rang to say she was standing in the bank making the transfer and had forgotten my bank details. I let her have them over the phone and she said the bulk would be in my account in 3 days. It is over a week and nothing has been returned. Everytime I ring her office she is 'in a meeting'. Every time I ring her monbile it is on answerphone. her home tel. no is ex.directory. It is now 5 weeks since the property was vacated. I don't want this to get nasty if i can help it as she is going to say there were other things wrong (how can either of us prove it now) I just want & desperately need my money returned. Advice please.

she is insisting the csrpets and curtains be cleaned. she has alreasy had settee covers cleaned and it cost £180. this seems exorbitant to me. what does anyone else think?0 -

Carpets getting dirty is fair wear and tear: no reason for you to pay for that.
Send a 'letter before action' giving her seven days to pay, and then complete the forms to claim through the County Court.0 -

unfortuneately I have lost my contract but apparently it stated that I would get them cleaned at the end of the tenancy. I did hire a carpt cleaner and they were fine. She had an electrician go in after I left and before she inspected. he could have made them dirty again.0 -

hmmmm, Pretty sure that "professional cleaning" is an unfair term. whatever, got the receipt?
tell her to go hang. Stick with my original advice, write a clear letter requesting all your deposite back within 7 days or you will start taking proceedings in the small claims court.

The Office of Fair Trading issue guidlelines on unfair terms and conditions in tenancy agreements. A rented property should be left in the same condition as when you started renting it, less fair wear and tear. Damage deposit issues are commonplace and it seems around 99% of landlords try to increase their income by making unfair deductions.
You should write to your ex-landlord asking for the full return of the deposit or you'll be taking her to court within one calender month of the letter.
If you don't get your money back, download form N1 from http://www.hmcourts-service.gov.uk/
and don't forget to add 8% interest to your claim.

if you have lost your agreement you are in a difficult position - was an Inventory done when you moved in ? If not, then the landlady cannot legally deduct anything from the deposit as there is no proof of the condition of the property when you first moved in.0 -
Clut is right! The check in inventory and the subsequent check out inventory are absolutely crucial for the LL and the tenant when it comes to a dispute.
Possibly, the LL means that the carpets should be steam cleaned and the curtains dry cleaned, which would be reasonable had they been given to you in that condition.
You should ask for a copy of the checkin Condition report. I doubt that it says that the carpet was steam cleaned or that the curtains were dry cleaned prior to you moving in.FREEDOM IS NOT FREE0
