debt advice

back in 2000 i took at a curry's account well due to problems when i was living at home i ended up leaving family home due to my father (too complicated)
anyway i totaly forgot about this and a letter came today from a solictor type person saying i need to pay £357.00
well i have just rung um and they would take £250 today, well i dont have that kinda money at all - (i am now a mum of 2 and my fella is in full time work, we dont get extra help with benifits)

so after begging them the would take £50 a month - which will leave us shorth but what can i do!

My question is how long can you have a debt till they wipe it off or dont they????
i always thought it wa 6yrs?? if thats the case its 7yrs ???

please tell me 2008 be happier:( :(

    Chickster.

Do not pay them or phone them again.

This is almost certainly statute barred (if you have not paid in 6 years). And despite what this lot say, acknowledging the debt verbally does not restart the legal responsibility to pay.

So hold here, or go to search and put in statute barred.

it will help other if you can name the firm who wrote to you. They may well be known here.
If you've have not made a mistake, you've made nothing

    Chickster,

RAS knows about these things and will be back to you soon. If you've had any trouble finding out about "statute barred" debts, please click here for further reading.

I'm sure that RAS will be back soon. Until you here more, please do not pay anything or phone them. If you think about it logically, they have waited over six years, so why panic into making a payment now.

If you get worried, please bump your post.

If the debt is over 6 years old and you have neither acknowledged it by making a payment or in writing, then it is "statute barred". Nothing they can do about that.

They might expect a payment tomorrow, but tough. I'm hoping for an Aston Martin tomorrow, but that ain't going to happen either, unless you want to send me one :j

You have rights under the law, so don't let them panic you into making payments for something that they haven't proven to you that you owe them money for.

Did you find the "Statute barred" letter? If so, then you should get that ready and send it via recorded delivery.

Please let us know when it has gone.
  • is there anyway of me finding if it has been more than 6yrs??
As i'm 99.9% that it has been 6yrs but i cant remeber what i did last week let alone 6yrs ago..
