Picture financial mis-sold PPI

Hi everyone not been on for a while have now recieved response from Picture with regards to our mis-sold PPi. Just to recap my husband and I tooke PPi in March last year at a cost of £22000, anyway I have fallen ill and am unable to return to work in my present job. Because of my illness and worries about how we are going to keep hold of our home, our loan is secured on our home, I am now suffering from major depression and have been prescribed tablets as I am quite suicidal at times. I contacted our loan company for a claim form and was told I could not claim for sickness through our PPi as I was not covered for this, only death. I then looked on this website and as we were mis-sold the policy wrote a letter, with the help of Martins template and advice from Tiggrae, to Picture. we have recieved a reply today. Basically telling us to get stuffed as It was my fault and I agreed to the policy.
This is their reply to my complaint:
Dear Mr Mrs Pickup
Thank you for your recent letter with regards to the Picture payment Protector (PPP) insurance policy on your loan. I am sorry to hear that you are not completely satisfied with the level of service you have received from Picture. however, after having conducted a full investigation we do not believe your insurance was mis-sold. The concerns you have raised are outlined below
You were led to believe that both parties would be equally covered on the insurance policy
We are in breach of the Sex Discrimination Act 1975 by automaticlly naming the female customer as second maned applicant on the insurance policy
A full case review has been completed by the compliance department in order to answer your concerns and bring this matter to a close.
On review of this investigation I can now confirm that your loan consultant discussed the policy in great detail with both parties. The loan consultant explained that both parties would receive life cover but only one would recieve the additional Accident, sickness and unemployment cover. You were also advised that it is entirely up to youwho was named as the first applicant on the insurance policy. It was advised that youchoose the highest wage earner to which Mrs Pickup advised 'Yeah well do that then I think, he does earn more than me'
The loan consultant did not automatically add Mr Pickup as the main PPP applicant infact Mrs Pickup chose Mr Pickup to recieve the full cover. It was also disclosed that Mrs Pickup suffers from food allergies which can be life threatening this was added as a pre-exsisting medical condition therefore Mrs Pickup would not be eligble for full cover anyway.
In the circustances I regret that I am unable to uphold your complaint that the payment protection was mis-sold I trust the above has been adequately explained the reasons for this decision and thank you for providing us with this opportunity to address your concerns.

I can only say that if this was the case why did I bother to ring for a claim form in the first place. My husband does not remember speaking in great detail about the policy and neither do I. It appears that we were mis-sold the policy anyway as why would anyone advice insurance for someone with a life threatening illness who woud never be covered anyway. There is no way we would have signed up for a five year policy with interest to be paid for 25 years under these circumstances. Can anyone give us adive please on where we go from here. Sorry it is a long one. Thank you:mad:

Hi Dialysis/Mrs Pickup. I've read your most recent post. Can I ask how you applied for the loan and PPI? Phone/internet/bank? Were you given any documentation which identifies what the PPI covers you for and just as importantly, does the documentation clearly state the very specific level of cover for both you and your partner (referred to in their response)?MSE - The Stig0

I noticed in your post that you said only one of you would be covered. Look at the Martin's mis-selling article again. I think it says that "it is unfair to have only one party covered by the insurance if both parties are liable for the mortgage or loan". So in your case was the policy not worthless. If the person named on the policy was ill and could not work, then the other person should be able to pay on the basis that if both parties take out the loan then they are "jointly and severally responsible for it" thereby making any policy, where only one person is named / covered, worthless.

We are having similar problems re ppi with this really helpful company. My husband has a pre-exisiting condition but has not seen the Dr about it for 14 years - a fact our Dr confirms and neither has he lost any work through it.
We appealed and have heard nothing - they say they are waiting for our Dr's report which they have asked him for but our surgery tell us that Picture Insurance has refused to pay for it. In a catch 22 situation and only when threated with legal action (husband off work for 6 months now) have they agreed to pay our Dr. Still waiting to hear though. I'm going to my MP next week as this firm really takes the biscuit. I wish I had never ever contacted them but at the time we were in dire straits. Haven't missed any payments with them yet but struggling now and have been told that these people are sharks which really worries me as our house is security.
Very good luck anyway with them. I'm also going for a mis sold policy but don't hold out much hope.0 -

I had a similar problem with another loan provider who, as part of the terms of my settlement, I am not allowed to identify, but lets just say their name starts with "P"!!
In my opinion, don't waste your time with FSA or FOS, they take ages to do anything and generally they side with the companies because they have all the evidence (i.e. phone call recordings etc.)
We'll I have 2 separate reccommendations, (1) Always record your telephone calls from now on when dealing with the loan company [if you can't do this yourself there is a cool service from StealthNet calls www.complaintcopy.com] and (2) try submitting your claim via a claims management firm- they may be ur usual breed of no-win-no-fee players, but I can say from experience they got the job done very quickly- well worth the 15%. I used www.WeComplain4U.com/paymentprotectioninsurance, but there are plenty to choose from.
At least if they fail they won't charge you anything!
Anyway, whatever they outcome, I wish you all the best of luck and hope you get the outcome I did.
