    Over 10 years ago i run up debts with barcley cards for over £1000 over the years their has be letters sent from different companys who have taken over this debt but i have never contacted them. well in the last 6months a new debt company have contacted me about the debt and i think they have been knocking at my door and today i answered but told him to go away as i wants intrested in anyting and he said i just wanted to c if someone lived here. i shut door and paniced. im now really worried as im a single parent on benifits and cant pay back. I think its barclays or may abby and the overdraft i hadnt paid. could i write the letter about the account being barred or should i just ignore it. im getting really worried they will try and take the little things i have. please what can i do

    Have you actually acknowledged the debt? If so you have to pay it. If you have ignored every warning then continue to do so. you don't have to pay them. I think outstanding debts that have had no contact after 6 years you don't have to pay unless you acknowledge them or something. Someone else will confirm this,

    A debt will be "Statute Barred" if there has been no acknowledgement of the debt you making a payment or in writing within the relevant limitation period.

    If you are in England/Wales then the limitation period is 6 years and read:

    If you are in Scotland then the limitation period is 5 years and read:

    Link: Factsheet | Liability for debts & the Prescription & Limitation (Scotland) Act 1973

    If you feel the debt is "Statute Barred", then there is a letter to write at the end of each factsheet.

    But if you are unsure, then it would be best to ring National Debtline free on 0808 808 4000 to talk to a professional advisor about it. They can help you work out the best thing to do.

  • i dont think i have every owned up to it well i dont think i payed any money. i was ill at the time and then moved and wasnt on the electrol roll for ages so they couldnt find me. the letters i have been ignoring but im sure the man that knocked was from them and thats what worries me. thanks so much for the quick response.

    Unless a CCJ has been granted, then the debt is excluded from being "Statue Barred, although the DCA MUST take leave of the court before enforcing the debt.

    I am trying to sort out a problem with somebody. Briefly, divorced in 1986, solicitor dumped the case leaving person to act for themselves. They tried to take a case against the negligence but got more entangled over years of trying to deal with it all and are under care of psychiatrist. Bout 2 weeks ago right out of the blue the LSC sent a letter making a claim relating back to 1991 in sum of approx £10,000 saying it was some kind of order attached to their property. My colleague has lived at the same address for over 20 years and hasn't heard anything about this before now. What can I do to help as their stress and anxiety is increasing daily.
    Sorry if I did this posting wrong but it is the first time I tried this to get some help somewhere for them.
