Hey guys,
So
I sent the BPA template email yesterday whilst on holiday (about 25 days after) and then have just logged in to see this!
I have sent the BPA template to them with the registered keeper's details but that states there was no admission as to who was driving. What would be my next move in this situation?
Edit: I sent a follow-up email following Coupon-mad's advice above so will update the thread once I hear back from them.
Thanks0 -
A quick update,
I follwed the advice above and sent the IPC template and just recieved this back from them.
Thank you for confirming you were the registered keeper of the vehicle on the day in question.
We are only able to deal with the driver at this stage as per the guidelines set out by our accredited trade association (ATA).
If the driver wishes to appeal the parking charge they must do so directly to us within 21 days (beginning with the day after that on which the parking charge notice was given). When appealing, the driver must supply a serviceable UK address.
You should be aware that if the driver fails to acknowledge their liability in relation to this matter, the registered keeper of the vehicle may become liable to pay any unpaid charges in accordance with the Protection of Freedom Act 2012.
Thank you
Premier Parking Solutions Ltd.
Can anyone give advice as to what my next move is?
Thanks0 -
PPS switched to IPC on 1/3/16 but many of their signs still say that they are BPA members. Not sure whether this can be argued as an incorrect contract but you won't be able to appeal to POPLA it'll be IAS and they're DEFINITELY not independent! Sorry to break the news to you.0

Mmm. I got issued a PCN from PPS in Exeter on 12 March 16 and got given a POPLA reference... Are there two Premier Parking companies in Exeter?
No. Yours wasn't PPS!devoncrazylegs wrote: »A quick update,

Well as per the NEWBIES thread post #3. Ignore them, unless you want to wait for the NTK then appeal again as keeper (same as before) then possibly register intent to appeal to the IAS, just to see PPS' hand because that makes them produce their 'prima facie case'.
Not because you should appeal to the IAS, I believe that most people should not.
Registering 'intent' to IAS, maybe...is what I am toying with as advice in future just to flush out some which might cancel or be so fatally flawed as to be worth proceeding to IAS (rare).
But to get there you'd have to wait for the NTK in the post then appeal to PPS again, as keeper still. Pathetic isn't it?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi,
I thought I'd update this as I forgot to at the time and it might come in handy.
So, after doing all the things I have said above and repeatedly sending the template back and asking the same questions every time they threatened me, plus after receiving my notice to keeper I never heard anything back. I asked them to tell me why they were still advertised as being part of the BPA on their website and funnily enough never got an answer.
It seems like they have given up.0 -

I did forget to add that I asked my friend who's a solicitor to pen a letter for me on my behalf signed from his law firm so that may have !!!! them up a bit. I'll link the letter when I have a chance.0 -
a letter from lord denning would not stop this scum , you or even your cat would know more about private parking than your solicitor friend
6 yrs is the max time they have to bring a court case , just look at the number of 2010 onward cases that B+W are bringing and look at the misery caused (see this forum) by people getting CCJs at an old address
you are a long way from free , MIL were buying old claims for as little as £1 each , 5 and 3/4 yrs to go before you can relaxSave a Rachael

There are many cases where people with unresolved PCNs have moved house. The PPC has only the original address they were given by the DVLA, and that is the only address they can use (unless the motorist informs them in writing about the change).
The PPC has 6 years to pursue the claim to court and can issue court papers at any time in that period. If they go to a former address and you are blissfully unaware of their issue, you won't respond and you get an automatic CCJ with potentially devastating consequences for your creditworthiness.
There are hundreds of cases currently being raked up by PPCs and their bottom-feeding solicitors which has even attracted the attention of Theresa May.

Yes please, do let us see a copy of the letter drafted by your solicitor friend. You can't post live links just yet (not enough forum posts under your belt), but if you host it on a free photo hosting site like Tinypic or Photobucket, then copy the URL, paste it into the thread Reply box, changing http to hxxp, a regular will do the conversion.
I'm sure the letter will be very helpful. Thank you for feeding back the progress in your case. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
