Debt letter from Meritforce doorstep collections..help please

letter recieved today and made me an offer, go too the bottom of the thread.


Ok i had a letter from buchanan + wells last year demanding £210 debt, they were collecting for Vodafone, i sent them a letter asking for the contract as i dont recall the debt they were asking for, they did not reply but carried on sending letters, but a few months on i have now received a letter from Meritforce doorstep collections, saying i have 10 days.

What can i do about this?

The letter i got is below and also the Letter headed in BOLD.....


AUTHORISED COLLECTOR VISIT

due to non payment of the above sum we have been instructed by macenzie hall limited, to collect this debt on there behalf.

an authorised collector will make a visit to your property within the next 10days

should our collector inform us that no positive commitment towards clearing the debt has taken place, your account will be returned too this office and a formal proceedings may be considered

if you do not want our collector to call and would rather arrange a settlement with us you must contact us immediately.

should you fail to make a payment and action is taken additional costs maybe added to your debt.

we look forward to hearing from you, we will not send another reminder.

    Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me by telephone over the past few weeks/months and these have been duly logged by time and date.


    Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.


    There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.).


    Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of
    trespass and action will be taken, including but not limited to, police attendance.

    I remember having one yes, but i know it was a long time ago, how many years though i dont know. i need do something soon though as the letter is dated 21st oct.

    Thanks alot, do i send this too the agency its self then? and i take it i dont sign it at the bottom?
  • also i want send them a letter saying i dont akowledge the debt and want proof, anyone on here have this? and can i send both letters?

  • Thank you for your help, i will post the reply should i recieve one of them.
  • Did you send the letter? Dud you hear anything back?! I've had the same thing last week however I stupidly rang Mckenzie hall they weren't particularly rude they just demanded I had to pay in full I cant afford to do that so i got off the phone to them and they have since been hounding me with calls. I do know that the debts real but it's from a phone company from around 3 years ago, anyone have any advice for me please? Thanks guys :)

    Nothing yet i am on day 13 of sending the letter out too them, i wonder what they will do next?

    When i get a letter off them i will post it on here.
