Advice needed-being pursued for gas bill that's not mine. Help!

Hello there,
I hope someone can give me some advice. This is my first posting (have been coming to the site for advice for years tho) so please gentle with me!
I am currently being pursued by a company called Buchanan, Clark and Wells (BCW) for a gas bill at a property I lived in 2 years ago but for a billing period after I had left.
The story so far- I left the shared rented house in Feb 2006 and moved into my current rented flat. I advised British Gas I had moved in here and the bill here is in my name. The bill at the previous property was in several names, but mine was the first on the list.
In Oct 06 I got a demand from Wescot Credit Services for £178.82 for a bill dating 7 Feb-17 Mar after I had moved out. After lots of to-ing and fro-ing I finally got a copy of the bill. When the dates were clear, I sent them a copy of my first bill at my current property and a letter explaining I could not be in two places at once and that I was not responsible for that bill. They agreed and closed the account sending it back to British Gas. I thought that was the end of it.
Then in Dec 07 I got 2 nasty red 'formal demand' and 'final notice' letters from BCW demanding the money. I wrote to them including the 2 copy bills and details of the correspondence with Wescott. They sent me another 'legal notification' and I then telephoned them and they said they needed proof of when I left the first address such as a rental contract, luckily I had the 'notice to quit' order for when we left so I emailed (didn't work) then posted this to them. This was all done in early January.
Two months later this week I got a letter from them saying they had a response from their client and I should call them. I spoke to them yesterday and they advised me that they now needed the final meter readings from the last property. I don't have these as it was over 2 years ago, and another tenant was paying the bill via direct debit. I do however know we were in credit when we left, and the bill is clearly dated AFTER we left! I pointed this out to the operator and said I didn't understand how I could be pursued for a bill that wasn't for dates when I was living there and he said he 'agreed with me morally but not legally'. Fine. He then told me I have til early next week to find evidence or it will go to solicitors and I will be forced to pay this.
I really don't know what to do! It is highly unlikely we will be able to find meter readings and I really don't what other evidence I could poss come up with. It seems like every time I provide something they want something more.
I am normally quite good at dealing with issues like this-I am paying off all my debts and dealing with redundancy at the moment- but my father died last wk so in the midst of all this I am sorting out practical arrangements and trying to organise all my mother's finances and bills to ease her burden and this pursual really feels like the last straw and too much for me to cope with right now.
I am going to contact the CAB on monday but any advice that anyone can give would me so so welcome.
Sorry for rambling on and thanks so much for your time.

British Gas are also sending similar letters to my flat, I get my power from scottish power, always have done, been here nearly 3 years and so did previous tenants!
Letters coming in addressed to the occupier - open tehm and theres a demand for bills! Ive called them repeatedly and nothing happened. Went thru energywatch and they gave me a number for british gas complaints team - at highest level apparently, and got a letter stating that letters I were receiving were in error and wouldnt get any mroe. CAB were also helpful - if you cant see tehm, call them or write to them, got a reply very quickly.
Still recieve letters but I now ignore them, or send them pack in payments envelope lol!
But if its your name on the bills, would contact hte complaints team and get a written assurance from them. The call centres are useless and cant get anything sorted out!
Not sure about if same advice can appply to debt company but maybe see if contacting british gas complaints team would help stop debt companies chasing you?
Hope you get things sorted out.:j Debt-Free-Wannabe! :jDeclutter/Ebay/Savings0 -
First of all settle down you cannot look at it logically while your upset.
When you moved out did the others you were renting with leave also?
1) can you get a stament from them about you leaving.
2) can the land lord make a statement
3) Gather all your evedance
Copy all your evedance and enjoy writting a nasty letter to Britrish gas and BCW and wait. If you know you are correct (double check) and you have backup evidance let them have their little moments. remember you could be the one who gets compensation out of this!
Probability is that the land lord has refused to pay or the subequent tenents have refused to pay
Go on enjoy your self your in a win win situation.June 2005 = 48K of Debt
Sept 2006 Started dmp = 56k of Debt (inc fees and charges) DFD April 2030:eek:
May 2008 = <5k of Debt (CCA route -48K, paid off 3K) DFD April 2010
Nov 2008 Lloyds found CCA for 14K loan:mad: New DFD Jan 2016
Happy so far tomorrows another day0 -
I had similar issues with british gas and it took over a year to resolve. It was finally resolved by giving them the meter readings for the 4th time as they kept "losing" them. You really need to find the meter readings, would your landlord have them? I know not all LL are organised though. What about the new tenants? Would they have their moving in readings maybe?0

I've had a similar problem, recently. I wrote to BCW and the organisation with my evidence and sent it recorded delivery to them. BCW were excellent in sorting out the 'misunderstanding' as they called it and I also lodged a formal complaint.
You have a lot on your plate at the moment, send your letters in to BCW and the chief exec of british gas, also sending a copy to their complaints department.
I wish you all the best with everything that is going on for you right now,
LornaThanks for the advice Martin! :money:Member no. 920 - Proud to be dealing with our debts0 -
OOoooooooh, I'm glad to know it wasn'tjust me!!!
They did this to me a few years ago and only called the pack of wild animals off me when I got Energywatch involved. They were chasing someone whose first inital and surname is the same as mine. Apparently the highly sophisticated tracing company they used found me via the, er, phone book! That's right, they just send the bill to someone who sounded like the person they were after - didn't even check the electoral register to see if it was the right person - just started sending demands and harrassing me left, right and centre some 9 or 10 times a day.
It did take a few Recorded Delivery letters from me, a 57 minute phone call (on my mobile (DOH!) and eventually a letter to Energywatch before it was sorted.
The person they were after still lived in the property where he ran up the bill which really annoyed me. I took the bill to his door and told him to f*****g well pay it.Almost debt-free, but certainly even with the Banks!0 -
I recently got these contact details from the Energy Ombudsman to make a formal complaint to B-Gas and I had a response within 48 hours.

Thanks so much everyone. Your encouragement has cheered me up. I am going to write another letter to BCW reiterating the situation and a letter to the British Gas complaints team (ta for the address) and send BCW a copy. Hopefully things should improve from there. I am worried that I do not have the final meter readings but cannot afford to pay someone else's bill so will persevere. I will update you all on any further responses.
If anyone else has been in a similar situation please do let me know!
Just got a lovely letter from SRJ Debt Recoveries about an Amex balance I've already paid too so must be the week for it. Ah, it never rains but it pours0 -

I had a similar problem when BG set BCW on me to recover money from my previous house. In fact BG owed me money and it took 21 months to get it out of them. On BG bills there is an address for their complaints dept (wonder how big that is? ). I wrote to them and they sorted it in about two weeks. Angela Mancini was next on my list but I didn't need her.

We received a letter from BCW for someone who didn't live at our address, and I binned it. A week later, another letter from the same address arrived - I googled the address and found it was a DCA in Scotland, so I opened the letter. It was something to do with unpaid gas bills...which was odd, given that when we bought our house, it didn't have gas and so we had it fitted and therefore the gas account has only ever been in our names.
I called British Gas, told them the situation and they told me to contact the DCA directly. I repeated the situation, and pointed out that
a) it wasn't my problem
b) I didn't intend to make it my problem
c) I was going on holiday the next day and didn't have time to deal with it
d) it still wasn't my problem
At that point, the guy became very helpful, called through to some internal departments, etc, and told me it was a mistake and would be resolved.
Moral of this story - if it's their mistake, make sure they know you know it.Virtual sealed pot challenge #036 - 19/01/09-1/12/09 = £483.71/£750
