Hi all,
I had a cheque bounce this month leaving me with nom money in the bank (Halifax), who went ahead and paid half of them anyway they then sent me a letter charging me for all the ones they had paid and all the ones they hadn`t!!! When i phoned to explain the situation they told me it was my problem and that they were also going to charge me a further £150 PER WEEK! in interest until i paid in full, when i queried this as being legal they told me that if i dont pay they will hit my credit rating.
This is really worrying me as they say they want £800 by Friday, i am sure this cant be legal.
If anybody can help that would really help.
Thanks

These are exactly the type of charges we are all chasing! The charges are unlawful and you should call their bluff! Tell tham that if they want to take legal action, that you will put in a counter claim against them.
Sorry, I never checked, have you claimed any charges off them before? IF NOT, when you tell them that you will put in your counter claim, ask them for a list of all your charges from the past 6 years
See Martin's artical for tempalates and guidance

Write to them listing the details of the telephone call and asking them to confirm them. Pretty much the entire call breaches debt collection regulations. I guarantee the letter you receive will not repeat those threats but will give you written confirmation of the exact state of the account and you can deal with it from there. From this point on do not deal with anyone from the bank by phone and insist on written communication.
The thing to remember here is to stay calm. No they cannot demand £800 by friday and expect it to be made. Do not pay this. Any arrangement you enter with them must be in writing and agreed prior to any payment actually being made.
As advised above reclaim the charges. Follow the steps as laid out in the main article and submit your SAR (Subject Access Request) without delay. Come back to the forum for help and advice. You can counter all their actions its just a matter of knowing how

Sorry, I don’t get it.I had a cheque bounce this month......bank (Halifax), who went ahead and paid half of them anyway.....charging me.....when i phoned to explain the situation......
That bounced cheque, was that one you had written or one you had received? Bank went ahead with paying what? Were those cheques or DD you had issued previously? Did you try to cancel those? What about the person who issued you with the bounced cheque (presuming this was the case)? Have you contact him/her? Is the cheque going to be represented or was it “refer to drawer”? Have you undertaken any steps to get the money?
I’ll take it, you only contacted your bank after the **** had hit the fan. Never a good thing to do!
I think you have to supply more information, for anybody to understand the chain of events.0 -
I understood fine thanks
