Rights on getting delivery refunded?

    Thanks everyone. I sent the store an email earlier and this was their response:
    I am sorry but we don’t refund the original postage .
    Kind regards

    I replied with some of the information I was given in here so just waiting on a response to that now probably Monday.

    It may seem petty with delivery being under a fiver but to me its the principle.

  • It's not petty d_low, they are acting illegally.

    Under the DSR's as long as you cancelled the contract within 7 working days they MUST refund you their delivery costs.
    It they don't play ball quote them the DSR's in writing if you have to and then mention trading standards and that should be enough.

    Yes as you say it may not be a lot of money but it is the principle and companies like these should not be allowed to get away with this behaviour.

    I know you said it was a shirt......just to double check.......it wasnt personalised or anything?

    There are certain products that are exempt from the DSR's - custom made goods being one of them - which would mean the company do not have to offer a refund.

    And also i should point out that if they are (for example) a chinese company, they are not bound by UK legislation.

    Exactly. If no one done anything companies would be getting away with everything :(

    And yeah it was just a shirt. Not personalized or anything. Shop is based in the UK too

    Right bit of an update. Tried contacting the store 3 times now and since them replying first about them not doing delivery refunds they have chosen to ignore all my emails. They have a phone number but I cant seem to get hold of them. They are a legitimate online shop and have an actual store based in the UK.

    Anyone know what my next step would be? I know it's only deliver costs but for their ignorance of not replying I really dont want them to get away with this ha.

    Is £5 really worth your time and effort, name and shame them and it will cost them more than the £5 they should have given you back.

    Im kinda at your position, ive contacted the seller and am waiting for a reply. I know im going to get the 'your not getting a refund on postage' reply, but for me the seller is to cover both postage out & back as they did not state it in there emails, only on the website. (Para 3.10).

    You could go with a chargeback if you paid on credit card, or even start to write them a 'Letter before Action', sent recorded & normal post, Then follow the small claims pathway. A £5 refund, soon becomes £45 claim and starts to teach them a lesson.

    Im in it for a bit more, just under £160.

  • Just going through this with a Supermarket mobile phone, they sent wrong phone,I returned it within a couple of days for a refund,just got a refund 2 weeks later minus delivery costs.Maybe it is only a few quid but why should they get away with it?
    Went shoplifting at the Disneystore today.

    Got a huge Buzz out of it.

    In that case you should receive a full refund as the fault was theirs. Even for any postage costs you paid.

    Play.com also have a policy of only refunding £1.40 of whatever the customer pays to return it. You have to send them POP to prove the price......although common sense to me anyway, would say why not check the postage stamp on it?
